Hi all and thanks for your time.

I am investigating this problem for a friend of mine who wants to live in Thailand.

He is 39, his girlfriend is 30 and they have a daughter who is 4 months old and a son who is two years and two months old.

They are currently on a Tourist Visa which is about to end. They are all Dutch, but not married. His son is currently in nursery school in Thailand.

They have funds coming in from overseas, so no need to work now, although he might want to do some business at some time.

Can somebody help me show them what their options are. Or point me in the right direction.

They are not a family by Thai law and do not appear to qualify for anything but a tourist visa for short visit under stated conditions.

When the child goes to school, he can gets a visa and extensions of stay from immirgaiton based on education. The mother can get a permisison to stay in Thailand to take care of the child, but will need to show 500,000 baht in a bankaccount.

The father can take up his own study, while for children under 15 years old no overstay is charged. Possibly the youngest child could be a dependent of the fahter, but the fahter must be the legal fahter of the child (have legitimized the child).

Not 100% sure and might depend on immigration office and the school. The best thing to do is first talk with the school to check if they have other students with a non-ED visa and extensions. The school would nee to provide paperwork for the visa and extensions of stay anyway.

Samui immigration informed us that this will only work if the child is 6 years or older,

since that is when the compulsory education starts in Thailand.

So back to the drawing board.

I guess getting a education visa is the cheapest and most easy way to get things done.

If my friend would get married with his girlfriend will he than only one visa/education

and his Dutch "wife" can than get things easier/cheaper? Or will they still have to get

two education visa's?

If it would make a difference, would it be enough to marry for the Thai law or do they

have to marry by Dutch law?

Anyone have an idea what price tag is attached to something like this...

Marrying by Dutch law or by Thai law makes no difference, a marriage in either country is recognized by the other country.

Under 2.11 of the relevant police order the other members of the family could get extensions of stay, but will possibly be for 90 days at a time. (at 1,900 baht per person).

Ok. So just one last time to confirm.

If one of them follows education and receives an education visa.

The other, after marriage, can stay without visa. Just immigration stamps.

After marriage, the other will need a visa (a non-O visa based on being a dependend), but can get an extension of stay from immigraiton based on the other spouse studying and living in Thailand.

A visa is nothing more than a permission to travel to Thailand. That permission (visa) needs to be of the right category in order to get an extension of stay.
