I have a non-imm O visa based on marriage that was issued in my home country before I arrived in Thailand two months ago. They didn't require me to have 400,000 baht in a Thai bank account for the initial visa, & I still don't.

Since arriving I have obtained a work permit. I am curious as to what will happen when my initial 90 days are up, when I need to go for the first extension?

My employer says everything will be fine, they will take my passport along to immigration on my behalf and everything will be okay. However I am not convinced. Will the visa change from non-imm O to non-imm B? And would I need to change it back again if I left the job?

You will be applying for a 12 Month Extension of Stay , not a Visa.

Whether that is based on Marriage or Employment is not clear. You will have to ask them.

I would think Employment in which case if you lose your job your permision to stay will end on the same day.

Apply for extension of stay based on marriage.

From Police order 777/2551

2.18 In the case of a family member of a Thai(applicable only to parents, spouse, child, adopted child or child of his/her spouse):

Permission will be granted for a period of not more than 1 year at a time.

(1) The alien has obtained a temporary visa (NON-IM)

(2) Proof of family relationship

(3) In the case of a spouse, the marital relationship shall be dejure (legitimate) and de facto;

(4) In the case of a child, adopted child or child of his/her spouse, the said person must not be married, must be living with the family, and must be less than 20 years of age; or

(5) In the case of a parent, one of parents must have an average annual income of not less than 40,000 baht per month or a money deposit of not less than 400,000 baht for expenses within a year.

(6) In case of marriage with a Thai lady, the husband who is an alien must have an average annual income of not less than 40,000 baht per month or a money deposit in a local Thai bank of not less than 400,000 baht for the past 2 months for expenses within a year.

Paperwork:

1. Application form T.M. 7 with one photograph size 4x6 cm. and Visa Fee 1900.-Baht

2. Copy Marriage Certificate

3. Copy Kor Ror 2 from amphur office (not older than six months)

4. Child's birth certificate (if any)

5. Copy wife’s house registration

6. Copy wife’s identity card

7. Copy passport, non-Im visa, arrival card.

8. Interview the husband and wife for confirming status of husband and wife

9. Map to residency

10. Picture of house and family, in house and outside showing house number.

With money in bank option.

1. Letter from bank same day or day before stating bank records, make a transaction just before to get it up to date.

2. Bank account must be in Husbands name, joint accounts will not qualify.

With Income in Thailand option

1. A copy of work permit

2. Personal Corporation income Tax (PND.1) in latest 3 months and personal income tax for previous year with receipt

With Income from abroad.

1. Embassy letter stating your income.

All of the above in two copies, if not in BKK

If you have not the cash in bank use rule 2.24

Off course if you are female ,easier rules apply. B)

60 day extension is pretty much routine. Apply at Immigration.

Apply for that and your money will then be in the bank the required 2 months.

Money in the bank is not needed for the 60 day extension.

Also the money must be in an account in your name only, not a joint account. So it needs to be in and seasoned before the expiration of the 60 day extension so that you can apply for the 1 year marriage extensiion

So what is the point of getting the one year extension,(where have to report every 90 days), as opposed to getting a 60 day extension every 60 days. Is it cost?

The 60 day extension can not be obtained on a previous 60 day extension - only on a new entry. One year extensions can continue on top of each other without leaving country or getting a new entry.

Just one more question, can I go to any immigration office to get this 60 day extension?

You must go to the immirgation office for the area where your wife/child is lving or officially registered on the household registration.

Just wondering, is the 60 day extension really per entry or just not allowed back to back.

I get extensions based on work. Last year the documents were a bit behind schedule so I popped to immigration to get 60 days based on marriage to give more time.

If the documents are slow again this year then can I do the same. I have had an extension between 60 day applications but have not been out of the country.

They are not given back to back, and some immigraiton offices seem to have additional rule. But there should be no problem getting one after a new 1 year extension of stay.
