Court acquits Jatuporn in case of Suthep's defamation

The Nation

The Criminal Court Monday ruled that red-shirt leader and Pheu Thai party-list MP Jatuporn Promphan had not defamed former deputy prime minister Suthep Thaugsuban in a comment he made in 1998.

Suthep alleged that Jatuporn defamed him when the red-shirt leader told a press conference on December 4 2009 that Suthep planned to have some 5,000 labour immigrants from neighbouring countries pass among red-shirt demonstrators.

Jatuporn said Suthep planned to have the immigrants destroy King's pictures on Rajdamnone Raod to prompt the public to be angry at red-shirt protesters.

The court ruled that Jatuporn had justified grounds to express the fear.

The court said Jatuporn and Suthep were political opponents and a senior metropolitan police officer testified that there were really foreigners among demonstrators and sometimes situations were created during demonstrations.

As a result, the court ruled, Jatuporn simply expressed the concern to protect his side's interest.

Yingluck says Pheu Thai has never discussed amending Article 309

Prime Minister Yingluck Shinawatra said Monday that her Pheu Thai Party has never discussed the amendment of Article 309 of the Constitution in details.

"We have not yet discussed it in details," Yingluck replied when asked to confirm reports that the Pheu Thai planned to amend the article, which sanctioned actions of the 2006 coup makers, especially investigations by the Assets Examination Committee.

Article 309 says: "Any act that its legality and constitutionality has been recognised by the Constitution of the Kingdom of Thailand (Interim), B.E. 2549, including all acts related therewith committed whether before or after the date of promulgation of this Constitution shall be deemed constitutionally under this Constitution."

Observers said if the article is repealed, all cases against former prime minister Thaksin Shinawatra might be dropped.

Culture Minister Unaware of Cabinet Reshuffle

The culture minister affirms there has been no signal from the prime minister over an imminent Cabinet reshuffle.

The minister also denies rumors that she wants to be reassigned to head the Tourism and Sports Ministry.

Culture Minister Sukumol Kunploem said there has been no signal from Prime Minister Yingluck Shinawatra about a Cabinet reshuffle.

Sukumol denied that she wants to be reshuffled to head the Tourism and Sports Ministry.

Sukumol's Palangchon Party wanted the tourism and sports portfolio at the onset of joining the government but since the number of its MPs is too small, it lost out to the Chart Thai Pattana Party for the seat and was assigned the culture portfolio instead.

The minister insisted that she is doing her best regardless of her position.

Asked to comment on the Pheu Thai Party's charter amendment plan, the minister said the matter has not been discussed among coalition partners.

She said the Palangchon Party will hold a discussion to further consider details and contents of the proposed changes.

Sukumol went on to say that it is normal to have political parties both favoring of and against the Constitution amendment, but she believed that the prime minister will consider what is best for public interest.

CHARTER AMENDMENT

Pheu Thai has never discussed amending Article 309

Observers said if the article is repealed, all cases against former prime minister Thaksin Shinawatra might be dropped.

Since the interim charter granted amnesty to the coup makers, Article 309, which sanctions the interim charter, is also seen as a double guarantee that the coup makers against Thaksin would remain absolved.

Partial wall cavein threatens Wat Arun foundation

The Nation

The month-long inundation and overflowing Chao Phraya River has caused an old wall at Wat Arun Rajwararam or the Temple of Dawn to partially cave in, which is threatening the stability of the ancient pagoda.

The cavein, about two metres in length and about half a metre wide, is no more than 10 metres from the main pagoda, assistant abbot Phra Khru Arun Thammanuwat said, adding that the structure could collapse or start leaning if the damage increases.

He said the complex would be closely inspected to see if the foundation of the pagoda has sustained any damages. The monk said he personally felt that the damage would possibly expand and affect the entire wall.
