Trespass Laws In Thailand

We are having a bit of an issue with our up-country neighbor. He has taken over 10 meters of our property. Six months ago our neighbor started putting his trash on our land. Several times we asked him to move these things off our land. Needless to say he has refused every time.

We asked the Village Chief to speak with the Neighbor. The Chief said the Neighbor told him that he will put his stuff wherever he wants. The Chief suggested we contact the Police.

The Police spoke to the Neighbor as well. The Neighbor still refuses to get off our property. The Police said they can't do anything about this problem. They suggested we hire a Lawyer and handle this through the Thai courts.

We showed copies of the Deed and the Plat to both the Chief and the Police. These documents prove we own the property. There are also Survey stakes marking the exact property boundaries.

What should be our next step?

We are in the process of having a fence installed but the neighbor's things would have to first be moved in order to install a fence.

How much stuff are we talking about? Ask the neighbor to remove his "lost property" ASAP and report the lost property to the police. After three days deliver the lost property to the police.

set it on fire, within your property. wouldnt grant him access to get it. complete the fence, and make sure you get some good photos of next trespassing

We had a problem where someone would force our fence open to graze their cows on our land. We talked to everyone in the village and the police, no success. We even chased the cows off our property to find their own way home. Which was a bigger disaster because this made the cows owner even more angry. It was costing us about 3,000 in dead/eaten baby trees each time. So we built a wall. We returned soon after the wall was built to find the cows grazing again and the wall pushed over. We couldn't prove the cow's owner damaged the wall so the police could do nothing but talk to the cow owner. The police did this time sternly warned the cows owner to keep away from our land. 100% frustrated with Thai justice we reinforced the wall. Within a couple of weeks, the cows where back. I was ready to kill someone or something. I this time took a bottle of whiskey to head of village and said the cows are back. We came to a solution in to the a second bottle. The head of village removed the cows himself and we kept and killed 1 calf for the damages. Thai justice working in our favor. Oh yes I did share the barbecued calf with most of the village for an open house party that next weekend. Your problem is not cows, but it still is the same problem, no justice. Build a wall as quick as you can or at least 2 m high welded wire fence (used to reinforce concrete). Make your case clear with the head of your village. Remove all the items from your property with village head knowing of your plans to move his sh*t off your property beforehand. Then on your side of the wall plant some pretty flowers where his sh*t was!
