Please be advised that we will no longer be able to process any orders.

Please see the notification we have received and this basically has tied our hands regarding any shipments made. We truly regret informing you of our action, however we do hope that you understand; and once Ms. Nalinee Taveesin is no longer involved with the government or removed from the SDN list, we can resume working together.

So you're suggesting that an American company can't do business with Thailand specifically because of Nalinee? I find that very hard to believe.

Here's the 2003 Executive Order by the president, focusing only on Zimbabwe nationals. As anyone can recognize in the language and in the laws, this is a serious matter. Note that Grace Mugabe appears as number 45 on this original Executive Order regarding Zimbabwe.

Executive Order: Blocking Property Of Persons Undermining Democratic Processes Or Institutions In Zimbabwe

By the authority vested in me as President by the Constitution and the laws of the United States of America, including the International Emergency Economic Powers Act (50 U.S.C.1701 et seq.) (IEEPA), the National Emergencies Act (50 U.S.C.1601 et seq.), and Section 301 of Title 3, United States Code, I, GEORGE W. BUSH, President of the United States of America, have determined that the actions and policies of certain members of the Government of Zimbabwe and other persons to undermine Zimbabwe's democratic processes or institutions, contributing to the deliberate breakdown in the rule of law in Zimbabwe, to politically motivated violence and intimidation in that country, and to political and economic instability in the southern African region, constitute an unusual and extraordinary threat to the foreign policy of the United States, and I hereby declare a national emergency to deal with that threat.

I hereby order:

Section1. Except to the extent provided in Section 203 (of IEEPA (50 U.S.C.1702), and in regulations, orders, directives, or licenses that may be issued pursuant to this order, and notwithstanding any contract entered into or any license or permit granted prior to the effective date of this order, all property and interests in property of the following persons that are in the United States, that hereafter come within the United States, or that are or hereafter come within the possession or control of United States persons, including their overseas branches, are blocked and may not be transferred, paid, exported, withdrawn, or otherwise dealt in:

(a) the persons listed in the Annex to this order; and any person determined by the Secretary of the Treasury, in consultation with the Secretary of State, to be owned or controlled by, or acting or purporting to act directly or indirectly for or on behalf of, any of the persons listed in the Annex to this order.

Sec. 2. (a) Any transaction or dealing by a United States person or within the United States in property or interests in property blocked pursuant to this order is prohibited, including but not limited to the making or receiving of any contribution of funds, goods, or services to or for the benefit of any person listed in the Annex to this order or who is the subject of a determination under subsection 1 of this order.

Any transaction by a United States person or within the United States that evades or avoids, has the purpose of evading or avoiding, or attempts to violate any of the prohibitions set forth in this order is prohibited.

Any conspiracy formed to violate the prohibitions set forth in this order is prohibited.

Sec. 3. For the purposes of this order:

(a) The term "person" means an individual or entity;

The term "entity" means a partnership, association, trust, joint venture, corporation, group, subgroup, or other organization; and

The term "United States person" means any United States citizen, permanent resident alien, entity organized under the laws of the United States or any jurisdiction within the United States (including foreign branches), or any person in the United States.

Sec. 4. The Secretary of the Treasury, in consultation withthe Secretary of State, is hereby authorized to take such actions, including the promulgation of rules and regulations, and to employ all powers granted to me by IEEPA, as may be necessary to carry out the purposes of this order. The Secretary of the Treasury may redelegate any of these functions to other officers and agencies of the United States Government. All agencies of the United States Government are hereby directed to take all appropriate measures within their authority to carry out the provisions of this order.

Sec. 5. This order is not intended to create, nor does it create, any right, benefit, or privilege, substantive or procedural, enforceable at law by a party against the United States, its agencies, officers, employees, or any other person.

Sec. 6. (a) This order is effective at 12:01 Eastern Standard Time on March 7, 2003; and

This order shall be transmitted to the Congress and published in the Federal Register.

This may be interesting but it does not answer my question to Buchholz - in what way does Nalinee being blacklisted by the US contravene the Thai constitution?

This may be interesting but it does not answer my question to Buchholz - in what way does Nalinee being blacklisted by the US contravene the Thai constitution?

The shame and tragedy of it is that a Thai national/citizen doing business with, or aiding and abetting Mugabe or his family, friends, associates and other named culprits is very likely both irrelevant and immaterial to the Thai constitution. I'd say the shadiness or possible illegality of it is more likely to show up in a bilateral treaty between the US and Thailand than in the Thai constitution. Perhaps so in the designation by the US of Thailand as a non-NATO ally.

The only statements we have on the matter are from the Pheu Thai government which silenced the opposition D party's inquiries into the matter. The Office of the Ombudsman already has said it hasn't any jurisdiction on absurdly interpreted procedural issues. It seems that in Thailand having such a person in an advisory position in the PM's office isn't any problem whatsoever. Who's surprised by the Thai truth? Who should be surprised?

You say shadiness or possible illegality - so the US can decide on the appropriateness of a Thai appointee on the basis of unproven suspicion? Sorry that doesn't work.

When you can assure me that the White House has never had advisors whose pasts were questionable I will accede that you might have a point.

Thailand is a sovereign country; there are no more empires

The US placing Nalinee on a list of people who US companies or citizens can not do business with has no effect on the Thai constitution. It does call in to question the logic used to place her in a position where she is to have trade discussions with the country who put her on the blacklist. These kind of things should make any normal government think twice before putting them selves in such an embarrassing position.

These things would cause a normal person to reconsider accepting such an embarrassing position, surely ?

In a 'normal' country, her position would be untenable. In Thailand, her 'crime' is utter small fry in the scheme of things. It's not even like she's the current guardian of the blue diamond, is it? wink.png

Atleast you are not pretending that they have any upstanding people than those in rotation now. It's like a trip to Mos Eisley.

Btw, do pretend you have any inside knowledge and tell us who is the current guardian of the blue diamond.

Here is the named person in all identities, to include all entities and locations pertaining to the person that were known to the United States Government at the time of the Executive Order..

Excerpts from the Executive Order 13469, signed July 25, 2008 by the president then follow the naming of the individual concerned. The Executive Order of 2008 contains stronger language than the original Executive Order of 2003. A number of companies around the world are listed in the 2008 executive order, to include a number in the UK and to include named individuals of several foreign governments, corporations and other entities.

I have italicized sections of the executive order that seem to apply best to the named person in Thailand..

Executive order 13469—blocking property of additional persons undermining democratic processes or institutions in Zimbabwe

by George W. Bush

July 25, 2008

By the authority vested in me as President by the Constitution and the laws of the United States of America, including the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.) (IEEPA), the National Emergencies Act (50 U.S.C. 1601 et seq.), and Section 301 of Title 3, United States Code, I, George W. Bush, President of the United States of America, find that the continued actions and policies of the Government of Zimbabwe and other persons to undermine Zimbabwe's democratic processes or institutions, manifested most recently in the fundamentally undemocratic election held on June 27, 2008, to commit acts of violence and other human rights abuses against political opponents, and to engage in public corruption, including by misusing public authority, constitute an unusual and extraordinary threat to the foreign policy of the United States, and to deal with that threat, hereby expand the scope of the national emergency declared in Executive Order 13288 of March 6, 2003, and relied upon for additional steps taken in Executive Order 13391 of November 22, 2005, and hereby order:

Section 1. (a) Except to the extent provided by statutes, or provided in regulations, orders, directives, or licenses that may be issued pursuant to this order, and notwithstanding any contract entered into or any license or permit granted prior to the date of this order, all property and interests in property that are in the United States, that here-after come within the United States, or that are or hereafter come within the possession or control of United States persons, including their overseas branches, of the following persons are blocked and may not be transferred, paid, exported, withdrawn, or otherwise dealt in:

Any person determined by the Secretary of the Treasury, after consultation with the Secretary of State:

(i) to be a senior official of the Government of Zimbabwe;

(ii) to be owned or controlled by, directly or indirectly, the Government of Zimbabwe or an official or officials of the Government of Zimbabwe;

(iii) to have engaged in actions or policies to undermine Zimbabwe's democratic processes or institutions;

(iv) to be responsible for, or to have participated in, human rights abuses related to political repression in Zimbabwe;

(v) to be engaged in, or to have engaged in, activities facilitating public corruption by senior officials of the Government of Zimbabwe;

(vi) to be a spouse or dependent child of any person whose property and interests in property are blocked pursuant to Executive Order 13288, Executive Order 13391, or this order;

(vii) to have materially assisted, sponsored, or provided financial, material, logistical, or technical support for, or goods or services in support of, the Government of Zimbabwe, any senior official thereof, or any person whose property and interests in property are blocked pursuant to Executive Order 13288, Executive Order 13391, or this order; or

(vii) to be owned or controlled by, or to have acted or purported to act for or on behalf of, directly or indirectly, any person whose property and interests in property are blocked pursuant to Executive Order 13288, Executive Order 13391, or this order.

I hereby determine that the making of donations of the type of articles specified in section 203(2) of IEEPA (50 U.S.C. 1702(2)) by, to, or for the benefit of any person whose property and interests in property are blocked pursuant to paragraph (a) of this section would seriously impair my ability to deal with the national emergency declared in Executive Order 13288, as amended, and I hereby prohibit such donations as provided by paragraph (a) of this section.

The prohibitions of this section include but are not limited to (i) the making of any contribution or provision of funds, goods, or services by, to, or for the benefit of any person whose property and interests in property are blocked pursuant to Executive Order 13288, Executive Order 13391, or this order, and (ii) the receipt of any contribution or provision of funds, goods, or services from any such person.

(d) The provisions of Executive Orders 13288 and 13391 remain in effect, and this order does not affect any action taken pursuant to those orders.

Sec. 2. (a) Any transaction by a United States person or within the United States that evades or avoids, has the purpose of evading or avoiding, or attempts to violate any of the prohibitions set forth in this order is prohibited.

Any conspiracy formed to violate any of the prohibitions set forth in this order is prohibited.

Sec. 3. For the purposes of this order:

(a) the term "person" means an individual or entity;

(b)the term "entity" means a partnership, association, trust, joint venture, corporation, group, subgroup, or other organization;

©the term "'United States person" means any United States citizen, permanent resident "alien, entity organized under the laws of the United States or any jurisdiction within the United States (including foreign branches), or any person in the United States; and

(d) the term "Government of Zimbabwe" means the Government of Zimbabwe, its agencies, instrumentalities, and controlled entities.

Sec. 4. For those persons whose property and interests in property are blocked pursuant to this order who might have a constitutional presence in the United States, I find that, because of the ability to transfer funds or other assets instantaneously, prior notice to such persons of measures to be taken pursuant to this order would render these measures ineffectual. I therefore determine that, for these measures to be effective in addressing the national emergency declared in Executive Order 13288, there need be no prior notice of a listing or determination made pursuant to section 1 of this order.

Sec. 5. The Secretary of the Treasury, after consultation with the Secretary of State, is hereby authorized to take such actions, including the promulgation of rules and regulations, and to employ all powers granted to the President by IEEPA as may be necessary to carry out the purposes of this order. The Secretary of the Treasury may redelegate any of these functions to other officers and agencies of the United States Government consistent with applicable law. All agencies of the United States Government are hereby directed to take all appropriate measures within their authority to carry out the provisions of this order.

Sec. 6. The Secretary of the Treasury, after consultation with the Secretary of State, is hereby authorized to submit the recurring and final reports to the Congress on the national emergency declared in Executive Order 13288, as amended, and expanded in this order, consistent with Section 401 of the NEA (50 U.S.C. 1641©) and Section 204 of IEEPA (50 U.S.C. 1703).

George W. Bush

PM Defends Appointment of US-Blacklisted Minister

Prime Minister Yingluck Shinawatra showed up for the House meeting today to answer the query posed by the Democrat Party about her appointment of US-blacklisted Nalinee Taveesin as Prime Minister's Office minister.

A positive step in just simply showing up to work this time.

That photo is begging for a caption. Chalerm "I know where you've been."

I'm sure ther is better than that.

"Whooo I can see daylight"

"So, you see, if they all lined up along the klongs and sucked...like this...there'd be no floods"

"Look I can do an impression of G W Bush"

"She's on the black-list?...but she uses the same whitening cream as me!"

"Sooo, what's the difference between a terrorist and an assassin that uses bombs again?"

Was 'due diligence' adequately done for both these candidates

to vet their suitability and qualifications for office?

Most countries would say no.

She should not have gotten past a proper veting process,

much less into office before this international embarrassment was found out.

Nutawat is under indictment for terrorism and causing public destruction,

only in a topsy turvy alternate universe can he be seen as appropriate and qualified.

So let the process continue as it should and must.
