hello guys new to the site this is my situation me and my thai wife have a baby boy we applied for six months family vistor visa and got no problem she stayed in england for 5 months and enjoyed it so we are going for the 2yr visa only problem i lost my job in the mean time i have started in taxi office doing 30 hours a week min wage top up with tax credits i come out with about 310 a week i was on about 420 a week in my last job will this effect our appliacation the baby was born in thailand but duel nationality many thanks if anyone can help <sorry if there is any spelling mistakes>

It should not be a problem as long as you can demonstrate you can maintain and accommodate her without recourse to public funds.

You are probably aware that a two year visa doesn't mean that your wife can stay in the UK for two years.

I agree with Paul's response but there is a danger that in applying for a longer term visit visa the ECO might believe, rightly or wrongly, that your wife is attempting to circumnavigate the settlement route.

Remember she can only stay any 6 months in any 12 guidance only.

Are you talking about a settlement visa? As your spouse she would get FLR then 2 years later you apply for ILR.

As she is on a visit visa at present the settlement visa application would have to be made back in Thailand. Having said that so would a two year visit visa!

It is not clear from the OP but it sounds as if you are working and based in the UK unless you are driving a Thai taxi! I assume your wife is still with you in the UK but again this is not clear.

As stated above the key concerns will be adequate accommodation and sufficient income as your wife will have no recourse to public funds but would be able to work.

hi bobrussell thanks for your respons my wife is back in thailand now her visa has ran out we are looking at the next stage she stayed in england for five months enjoyed it also we have a little boy he 7 months old and yes im based in the uk

hello i was talking about the 2 years family vistor but i got mixed up i thought it was the same as the settlement thanks for your help

A settlement visa 2 years :

  • Allows her to stay in the UK
  • Multi entry
  • Work

During her 2 years she must pass the KOL requirement or ESOL once she passes either she can apply for permanent residence.
