to legalize supporting my family

i am married a few years ago here in thailand. our marriage is registered

in thailand and in my home country. my embassy also knows i am married

and we have children. i stay here full time with a non o multiple visa.

three years ago my wife check at the provincial government office to get

a work permission for my freelance work on the web. they told her, if i do

build up a company, i would be active illegal to legalize my freelance work,

cause i have to employ staffs which i not have and not need! they suggested,

just to do the freelance work on my current visa ... which is illegal, i know!

my work has nothing to do with thailand, i do get payed to a bank account

abroad, a thai person can not do my job! i do not hurt someone, i do not steal

someone's work, i just take care my family and spend all the money here in thailand.

i know, there many others in a similar position. so is there really no legal

way do legalize my work? my family and i feel very vulnerable in this situation!

any useful help is much appreciated

You would have to have a Thai company to employ you - either your own for that purpose (where employees are needed) or working for a normal Thai company that can pay for your services (your agent/seller perhaps). In any case there is no easy answer as the expectation is a married male foreigner will take wife/family to live/work in there home country.

A possible answer is form a THB 1.0 captialised company in Thailand, and employ two persons, your wife could be 1 and you need 1 other, pay their tax and social security and appy for a WP on the back of this, you can do this as you are married to a Thai national and who ever you are doing work for overseas pays your Thai company, two years of verifiable company tax paid and your salary of around THB 50,000/m and you can get extension of stay, ie you will not have to visa run every 90 days...

Therefore in theroy this can be done

do what the goverment office says.Just make sure that all work related files etc is in the clouds,not on your computer.Your computer is emty and clean ,just in case.You dont work? you just playing computer games right?

It seems that most governments are way behind the times when it comes to this kind of work. They will probably catch up in another 20-30 years. Or maybe not. Most politicians who come up with these rules are completely disconnected from the real world and how it works. Any fool can see that they would be better off to allow you to wok freelance and get you to pay tax. But they just can't see this.

Your clients are not in Thailand.

Your bank accounts are not in Thailand.

You are not taking work away from a Thai.

You just happen to be in Thailand when you perform your foreign work.

It does not impact the Thai economy, except for you spending your hard-earned in Thailand.

The provincial government office told your wife not to worry about it.

If it were me, I would shut up, keep a low profile and not worry about it.

if i form a company i need to fake the documents of the employee, this is not the

way i like to go! i read on thaivisa, that it can happen they like to interview the staffs!

i think,this is not the right option for us ...

i never had something to do with the police, with the law. not here in thailand and also

not somewhere else ... to teach my children, don't tell someone i am working as a free-

lancer, because that can result that i have to go to jail and get deported ... that let all of my

family feel very vulnerable about our future life here in thailand ...

we have a low profile life, we are carefully, we just have a few, trustful, close friends! we

hardly go out (not once per month), we prefer a peace full, quiet, modest life ...

if there is no change in the labour law, there will be no "lawful option" for us!

maybe i have to prepare everything for my family, if the worst case happen.

it is a shame, even trying to do everything according to the law, it is not possible.

the thai law criminalize me. and my thai family will be affected as well!

Why would you have to fake anything (except perhaps the real need - unless unable to earn enough to pay for this method). You could employ the person and pay him. Perhaps all he has to do is collect mail and supplies but it would be a job and he would be a company employee. I understand it is not ideal but there just is no current provision for today's employment options of remote working (which I suspect is not unique to Thailand but exaggerated here by the broad definition of work).

In order to get all the perks you mention he will probably have to be on an extension of stay based upon marriage. Getting an extension based on marriage is the best option and then forming the company or it can also be done as a sole proprietor business. If he can get a letter from his embassy to show the 40K baht monthly income or put 400K in the bank for 2 months would be all he needs to get the extension other than all normal documents needed. Then after getting a work permit and paying taxes he could he can use his tax payments to prove his income for his next extension.

An additional advantage to setting up the business is that he use the tax payment a proof of income if he ever wanted to apply for permanent residency.

I wouldn't worry about going through all the paperwork to get an extension as I mentioned in my previous post and then set up the company or business. How much of a problem it will be to set up the company or business and getting the work permit will depend on which Provence you live in. You might want to hire a lawyer/accountant to help with the paperwork.

Being married to a Thai means that the only employees needed is your wife plus one other in order for you to get a work permit. Your wife can be the boss and the other can be the janitor/housekeeper. The primary reason to get the work permit is so that you can pay Thai taxes and legitimize yourself and use the income to get your extensions after the first one.
