Question About Extension Of Stay (Non-O) And Salary Requirements

I'm from England, 27 and I'm going to be extending my stay for supporting my wife and working in Thailand (non-o, Thai spouse). My current status is extension of stay non-o, "thai wife" based on the documents I gave them that stated I was making 50k a month, however I've switched jobs and am making 40k now.

The immigration is giving me mixed messages as to the salary requirements one time we phoned them up it was 50k another time I phoned them up it was 40k. My work permit is not a problem as the company I work for is a BOI company and the salary requirements aren't a factor.

This time when we phoned immigration up they explained it a little better and said they I have to pick the reason for extension between supporting my wife or business and that if it was an extension based on business the requirements are 50k whereas supporting my wife is 40k.

Does that mean that:

  1. Immigration are telling me that non-o thai spouse is 40k and non-b is 50k, but they're just telling me this in a really weird way?
  2. You can not work on non-o thai spouse? I didn't have any problems this year doing the same thing but the whole "you have to pick" thing has gotten me doubting.

You only have to have 40K income (salary) for an extension based upon marriage. If you were applying for an extension based upon work it would be 50K.

Perhaps when they say that you cannot work they mean that the extension does not give you the right to work without a work permit.

Not sure which immirgaiton office you called, but if you called the One Stop Office, they probably meant to tell you that you cannot get an extension of your work permit and permission to stay from them if you apply based marriage. For that you will have to go to the normal labour and immigraiton office.

Not sure what the income requirements for an extension of stay based on employment for a BOI company are, (the Onestop Service Center has different rules than immigration)

At normal immigraiton you can extend based on marriage with your income of 40,000 a month (unless you apply at Phuket).

(6) In case of marriage with a Thai lady, the husband who is an

alien must have an average annual income of not less than

40,000 baht per month or a money deposit in a local Thai bank

of not less than 400,000 baht for the past 2 months for expenses

within a year.

Thanks for the answers guys, really helpful. Sorry, one last question.. Is that 40k before or after tax?

40K befor deductions...personal experience, get extensions based on marriage if you can, if based on WP and you leave your job then its another visit to immigration with the wife etc etc etc

Gross pay so before tax.

Before tax, you must take your tax fillings with you.

At normal immigraiton you can extend based on marriage with your income of 40,000 a month (unless you apply at Phuket).

Extensiion of Permission to Stay in Phuket based on Police Order 777/2551/ Section 2.18 can also be done with a 40,000 THB pcm income, provided you can show evidence of tax paid (PND 1, 91), current Work Permit, etc.
