Intend to go work for an Australian Company based in in OZ (the company is in Oz) but the work is in Thailand I am Married to a Thai on a Non O visa just got a new visa, Can i or the company get a WP????? perfer the company get this belive its very easy for australians with the reciprical agreement between OZ and thailand less paperwork ect

You apply for a work permit, with the help of the company. Both of you have to fill in forms and submit documents. The work permit is always issued to the employee.

But to be issued a work permit, the company must be registered in Thailand or be a Thai company. It might be wise to contact a legal firm to guide the company through the process.

I am sorry but this stament is wrong (But to be issued a work permit, the company must be registered in Thailand or be a Thai company. It might be wise to contact a legal firm to guide the company through the process). you need to check!!! Australia has an agreement with Thailand in regard to this all Iam asking is can a WP be given on a Non O

On a non-O based on having a Thai wife a work permit is routinely issued.

A few labour offices seem to insist on a non-B visa, but that will not be a big problem.

Thanks just read the Australian Thailand free trade agreement its basicly automatic for Australians hardly any paperwork just need my APEC card no need for WP have to leave every 90 days no problem

You can not work in Thailand without a work permit - believe you will find that agreement/card is for business travel - not for work.

Sorry but you are total wrong please go and read

Interesting:

Temporary entry of business people

  • Thailand will grant a visa and work permit for up to five years' stay for all Australian citizens being transferred to work in Thailand within the same company (to be renewable annually) (previously one year).
  • Thailand will grant a visa and work permit for up to three years' stay for all Australian citizens entering Thailand to work on the basis of a contract with an Australian or Thai company other than their employer in Australia (to be renewable annually) (previously one year).
  • Thailand will not require a work permit for Australian citizens who are business visitors conducting business meetings in Thailand for up to 15 days, and up to 90 days for APEC Travel Card Holders.
  • Thailand will consider applications for visas and work permits submitted by an employer on an applicant's behalf and advise in advance of approval and (with visa to be granted on arrival subject to identity verification).
  • Thailand will permit all Australian business visitors access to the one-stop visa and work permit service (previously restricted to visitors representing or employed by major investors).
  • Thailand will permit all Australians who hold work permits to participate in business meetings anywhere in Thailand, including locations not specified in their work permits (previous work permits had to be changed if any work was to be conducted in a location not specified in the permit).
  • Thailand will reduce the number of documents required from Australians for work permits and renewals and work permits

But do realize that the 90 day entry is for business people, having meetings and making contracts with Thai companies etc. It is not for living and working in Thailand, for that the work permit is required as you said in your first post.

As an Australian I am interested in this topic and looked up the criteria for an APEC that is listed below.

Eligibility requirements

To be eligible for an ABTC, Australian applicants must satisfy the following business-related criteria:

• the applicant must demonstrate frequent travel (a minimum of 4 business trips in the last 12 months) from the applicant’s place of residence to an APEC economy (other than Australia) for business purposes; and

• the applicant must be:

– the CEO or regional/country head of a registered business entity; or

– an owner/director of a registered business entity; or

– a Board member of a registered business entity; or

– the CEO of an Australian-based business peak body; or

– an employee of a registered business entity nominated by the aforementioned CEO/regional head or owner/director of the organisation; and

• the business entity or Australian-based peak business body must be engaged in international trade or investment between APEC economies; and

– be identified in the current Forbes Global 2000 business list; or – have received an Export Market Development Grant from Austrade in the past 5 years; or

– have been a national finalist in the Australian Export Awards (administered by Austrade) in the past 5 years; or

– have been certified by an ‘approved body’ (see below)*;

and

• if the applicant is residing outside Australia be authorised for residency and work purposes by the relevant

immigration authority in that economy.

Not absolutely. I believe the law allows external audits by for example the foreign based head company.

Under the Australian/Thai FTA, Thailand will:

  • Thailand will grant a visa and work permit for up to five years' stay for all Australian citizens being transferred to work in Thailand within the same company (to be renewable annually) (previously one year).
  • Thailand will grant a visa and work permit for up to three years' stay for all Australian citizens entering Thailand to work on the basis of a contract with an Australian or Thai company other than their employer in Australia (to be renewable annually) (previously one year).

it's never quite as simple as it should be in Thailand........

I think the correct procedure for you would be to set up a representative office for your OZ employer in Thailand.

Note APEC Cards are easy to get BUT take a long time for processing Tip when you get application do not put too many countrys on as the application has to go to that country for proccesing Me i just put on 2 Thailand and China got the card as i had an ABN number it was handy at the airport use the express lane never thought about working it Thailand

Thanks for the advice but will be using the APEC Card can work here but must leave after 90 days same as a visa run if the Oz company wants to set up agent ect up to them but I am coverd

it's never quite as simple as it should be in Thailand........

Now you are understanding. Nothing is simple and nothing is without a lot of documentation. Nothing is what it appears to be in Thailand.
