Thai 'Red Shirt' trial 'likely to be postponed'

Bangkok, Aug 7, 2012 (AFP) - The terrorism trial of Thai "Red Shirt" protest leaders in connection with deadly unrest in 2010 is expected to be postponed because some defendants have parliamentary immunity, the defence said Tuesday.

Twenty-three figures within the movement, including four serving lawmakers, are due to appear in a Bangkok court on Thursday, but defence lawyer Karom Polpornklang said the hearing would probably be pushed back. "Some of the defendants are lawmakers who have immunity.

This case cannot be done individually as all the defendants were charged together and the witnesses and evidence are the same," he told AFP. One option would be for the court to schedule a hearing for after the current session of parliament ends in late November.

Two months of anti-government protests in Bangkok in April and May 2010 by the Red Shirts triggered a series of clashes between demonstrators and troops that left at least 90 people dead -- mostly civilians -- and nearly 1,900 injured.

The kingdom, which remains deeply divided by the bloodshed, now has a new government allied to the Red Shirts' hero, fugitive former leader Thaksin Shinawatra, whose sister Yingluck is prime minister.

Two foreign journalists were among those killed during the 2010 rallies, including Japanese cameraman Hiroyuki Muramoto.

Then prime minister Abhisit Vejjajiva, his deputy Suthep Thaugsuban and former army chief Anupong Paojinda will be called as witnesses in the official inquest into Muramoto's death which began in May, the court said Tuesday.

Police initially insisted that the military was not behind the killing of Muramoto, but Yingluck's government said in November last year there was clear evidence that soldiers were responsible.

Yingluck's government will say and do any thing to postpone the trial hoping to get amnesty for all concerned. To have them tried and found guilty would not reflect very favorably on Her, Her party, or Her Brother.

Given the amount of physical evidence and eye witnesses some might get off but there is no way they all will get off.

Doe's any one know what ever happened when they said they were going to try to follow the money trail from the red shirts back to the people who supplied it. Notice please you red shirt lovers I am not putting in a name for one of the suppliers.

Actually, this defence was said not only on Tuesday, but 1 year, 2 months, and 19 days ago.

So why would you think that the current Government with their Shiniwatra clan running the police and almost everything else now, would not charge any previous Government or Military personnel over the deaths. After all they could do, they are now the Government in power. It couldn't be because they would open Pandoras box now could it?

I can't help but see the hand of mr. "I'm through with politics" behind this. Pardon me if I sound like a conspiricy nut, but I also see his hand behind the bail paid by gov't coffers for Red Shirt inciters, and the 'get out of jail free' card recently given to the cops convicted and sentenced to death. If the Red Shirt riot inciters had half the cojones they have when shouting in microphones from a stage, they would voluntarily rescind their immunity, and face justice.

There is probably no term in Thai language for 'face justice' and it's certainly not a concept familiar to Mr. T or the dangerous thugs he funds and protects.

Opposition leader Abhisit Vejjajiva has offered to disqualify himself and his former deputy prime minister Suthep Thaugsuban from any future amnesty if the same measure applies to ex-PM Thaksin Shinawatra, while other people involved in the political conflict are set free.

The OP seems to be referring to the TRIAL, not the bail hearing due imminently.

If bail is rescinded, 19 of the 23 are likely to be getting free government accommodation (ie remand) until the trial , which it appears will be delayed to November. Given the cries (are you there PPD?) that red shirts are being held in remand unfairly, would it not be appropriate for the 4 MPs involved to give up their immunity so that their 19 partners in (alleged) crime do not face incarceration while waiting for the parliament to rise?

Junta justice, Tom? PTP have been in office over a year and no charges against RTA or government officers have been laid. So should that be "junta, Democrat and PTP justice" or just "justice".

A few weeks ago, a "drugs" operation in the north left 8 people dead. No police or army casualties. No charges.

In 2003, this was an occurance that left between 2500 and 3000 dead. Just one conviction in 2012.

So if I ever want to go on a murderous rampage, incite or take part in terrorism, or commit any other form of dastardly crime; I just need to make sure I am elected to parliament before charges are laid if I want to get away with it and avoid punishment.

Your time-line is wrong. Most of the red-shirt MPs were already charged before they were nominated as party list candidates, and are not "elected" by an electorate. Nomination of unsuitable candidates may yet see PTP disbanded.

More to the point, IMHO "guaranteed" MP positions were given as a reward for crimes committed (in one case to a spouse), to delay prosecution, and with a promise of an amnesty to absolve guilt by a "reconciliation" bill. Of course, voting for an amnesty bill which may save them from the death penalty would be a conflict of interest and by definition corrupt, but what's a corruption allegation compared to terrorism, murder and arson.

AFAIK, the DSI is not part of the elected government but part of the bureaucracy.

Did I say anything about those? No. Did I say those cases were treated fairly? No.

Here you have a conflict with clearly illegal acts on both sides and on one side people have never even been charged when on the other side, ....

12 months have gone by with no action, so not an urgent matter obviously, when compared to an amnesty for big brother.

If you think the DSI is not part of (or at least strongly influenced by) the government, please explain the change in the definition of Perjury, as applied to Yingluk.

Indeed. There was the usual fanfare from Chalerm, various wild accusations, the trademark" I'll have this solved in 5 minutes" nonsense then his disappearing act.
