Hello again people

My Thai wife and stepdaughter are waiting for their UK settlement Visas about 3 weeks now, the question is after this period of 30 months do they have to return to re-apply for the next 30 months ? also my stepdaughter who is 16 but will be over 18 at the end of the dependents 30 month visa should it be granted what happens then ? Im worried she wont be deemed a dependant child after this initial 30 month visa. Can any of you wise old owls throw some light this way please

They make the FLR application after 30 months, and the ILR application 30 months after that, in the UK.

Not sure about a child who turns 18 between receiving the initial visa and applying for FLR or ILR.

Just had a look, and I think that as they will be over 18 they need to make a seperate application as an adult.

If they are applying as adults does this mean they will need to meet the financial requirements in their own right I wonder? I really don't think these changes have been thought through! How many 18 year olds have that sort of income?

Hopefully you will tell me I am missing something very obvious and this post of mine is nonsense!

Annex FM 1.7 - Financial requirement, Section 3, Calculating the financial requirement - children, page 6

The higher financial requirement will continue to apply until the migrant partner achieves settlement on the 5-year family route. This will be the case even if the child turns 18 before the parent qualifies for indefinite leave to remain: the higher level of financial requirement will continue to apply, unless the 18+ year old has been granted immigration status in their own right, e.g. as a student.

If they are continuing to attract the application of the higher level of financial requirement, the 18+ year old’s income and savings will be permitted to count towards the financial requirement.

So they will still be counted as a child for the financial requirement.
