Dependant Visa For Foreign Spouse

Featured Replies

Hello

Sorry if this has been asked before, but I did search and could not find.

I am foreigner working here with proper visa and work permit. My wife is also a foreigner and may join me at some time

If she came on a tourist visa, could she convert to a Non Imm dependant visa in Thailand, and if so, what procedures and documents are required. If not, does she have to go back to home country to apply, and then again what documents are required.

I truly appreciate any guidance given.

Do you have a visa or an extension from Immigration?

If you have an extension then she can easily use yours and piggy back it.

She should get a single entry non-immigrant O visa before she travels. She will need copies of your extension and passport photo page along with marriage certificate. But it would be wise to check with the embassy or consulate to find out if anything more is required. After she arrives she could then get an extension of stay as your dependent based upon your extension.

There have been many reports of immigration not doing a change of visa status for dependent extensions.

If she does not get a non immigrant visa before traveling she might have to return home for the visa if you are from a country that has that requirement placed upon them.

If you could tell us what your home country is we could be better able to help you.

hi. I am a European and my wife is a teacher with workpermit. I am on a dependend visa.your wife needs a non O visa. you have to go with her to immigration with all you your paperwork, passport ( also copies) and a certified ( by your Embassy) document that you are legal husband and wife. (must be in English)her passport + copies and 2 photos of her. ( always have a few photos of you and your wife when you go to immigration)

Hi everyone,

My husband is still awaiting for his work permit, he was informed he'll get it in about a week. After he gets his work permit, how will he get extension of visa to one year? After he gets those two, can I apply right away for a dependent type O visa? In my home country, Philippines, they issue single entry non-immigrant O visa, which is good for 90 days. Does anyone know of how to extend my spouse visa when I get there? Will I be given also one year extension? And how about the 90-days max stay, do I have to do visa runs or go back to my home country even if I get extension or I can stay there straight without going out of the country every 90 days?

Also, if I get a tourist visa, can I change my visa to non-O when I'm already in Thailand? Or I should go back home and apply again for a new non-O visa?

Sorry guys for too much questions, I just want to make sure I get all the infos right before going back there. If there's anyone in Chiang mai, I would love to meet new friends when I get there as well. Thanks in advance everyone!

When your husband gets his work permit he will be allowed to work, but you don't give information indicating he will get a 1 year extension of stay. Depending on the job there is a minimum income requirement depending on his nationality he will have to fulfill.

If he does, he can go to immirgaiton in the last 30 days before his permission to stay ends, with paperwork from the company, tax documents showing he pays tax and his work permit. He will then get a 1 year extension of stay.

He can then send you a copy of his pasport showing the extension and a letter from his employer asking for a visa for you. You get the single non-O visa and get 90 day to stay. After 60 days you visit immirgation with your husband and his passport and marriage documents in English and you will get an extension to stay to match that of your husband.

If you get a tourist visa, you might need to apply in a neighbouring country for the non-O visa.

Thank you for the info. Initially, he will get work permit valid for three months. But after two months, he will be reapplying for a one-year work permit. Can he apply for extension of stay up to one year even if he initially gets 3 months work permit only? Or should he wait for the one-year work permit before he can apply for extension of stay up to one year?

I understand that I can only apply for non-O after he processed everything there, so I guess if I would be coming this year, I need to get a tourist visa first.

The extension of stay is independent of the work permit, so should not be a problem. But, if the WP is for only for 3 months because his contract is for 3 months than he will probably only get an extension of stay till the end of contract.

Thank you so much for the info! In the meantime, I will be getting tourist visa to stay with him.

Hi,

My husband got his work permit today valid until January of next year. Based on single entry type B visa, he is allowed to stay until around second week of December. But they will process a 1-year work permit for him after 2 months. Once he gets his 1-year work permit, can he extend his current visa or need to go outside Thailand and apply for a new one? Does he have to do border runs every 90 days even if he has his work permit and visa extension already?

Do you think I can apply for type O spouse visa even if his work permit is just initially valid for 3 months?

Also, once he gets 1-year extension, can I also extend my type O spouse visa? My passport will expire December of 2013. How many months should be the validity of my passport for them to grant it?

I'm just a bit confused with the 90-days maximum stay. Assuming I get extension of my type O spouse visa for one year, does this mean I don't need to do border runs anymore? Or i still need to do border runs every 90 days?

Again, thank you for all the infos.

Once he gets his work permit he can extend his stay for 1 year, as long as he has the required docuements and meets the income requirements.

For the non-O visa for you the current non-B with work permit might be enough, together with a letter from his employer confirming his job with the company and asking for a visa for you as his spouse. Maybe mentioning it will be a long term job.

Once he has a 1 year extension you can also get a 1 year extension as his dependent (provided you have the non-O visa)

The validity of the passport doesn't matter for your extension. What immirgation will do is give you an extension till the date your passport expires. Once you have a new passport you visit immirgaton again and they will give you the remainder of the 1 year extension for free in your new passport.

You should apply for a new passport about 6 months early, as if you need to travel many countries will require you have a validity of at least 6 months.

Thank you. Once I get the extension, do I still have to do visa runs every 90 days or I just have to report to immigration every 90 days? Sorry, I'm new to this type of visa, so I want to make sure I won't have problem later.

With a one-year extension of stay you only have to submit the form TM.7 "Extension of Temporary Stay in The Kingdom" every 90 days to your local immigration office.

The single biggest problem in communication is the illusion that it has taken place

Thank you!

Unless my coffee was spiked today believe above should read you submit a TM.47 address report every 90 days if you have a one year extension of stay.

Not sure if this is the most recent thread on this topic, but it's the best I could find, so I'll post my query here.

First, facts about me:

US Passport

Recently acquired 90-day Non-O (for purpose of retirement) at Bangkok C/W

In another 5 weeks or so, will be eligible to apply for 1-year extension of stay

Facts about my wife:

UK / Philippines dual citizenship

Under retirement age

Obtained 60-day tourist visa on our recent trip to Hong Kong [Maybe a mistake, should have applied for Non-O?]. Visa valid beyond date I will apply for extension.

With that background, my question is this:

After I obtain my 1-year extension, will my wife be able to convert from her tourist visa to a follow-on/dependent visa without leaving Thailand? Based on @ubonjoe's previous post, the answer to this question doesn't seem entirely clear.

If she can't convert in Thailand, would the process be to apply for a 90-day Non-O for my wife (outside of Thailand), then apply for the 1-year extension in Thailand?

We travel a lot anyway, so just going forward with visa exemptions would be tolerable for awhile, but it would be nice to get the dependent status arranged for the occasional times we don't travel for more than a month.

On a related topic, based on various threads I have read, can I assume that a translation of our marriage certificate [bali marriage, so in English and Bahasa Indonesia] would NOT be required? From the most recent update on another related topic, I surmise that we won't need another THB800K in a Thai bank, so that's at least one hurdle cleared.

Thanks in advance for any responses.

Your wife will need to get a single entry non-o visa from any nearby embassy or consulate. Immigration does not do conversions for dependent extensions.

Since your marriage certificate has English on it there is no need for a translation.

To get the non-o she will just need the marriage certificate plus a copy and copies of your passport photo page and your extension stamp page.
