My husband and I are both Malaysians with Thai work permit. I gave birth to my son here and we are going back to Msia to get his passport done.

My question is, does my baby need a visa if he has a passport when he comes back to Thailand?

My colleague told me that a baby with a passport can live in Thailand as long as they want until they are 12 years old. They are also exempted from the 90 days report. Is this true?

Can somebody clarify this? Thank you!

Your baby is welcome to stay until 12 without a visa, but once you leave the Kingdom your baby is under the same rules as you. I'm not sure if there is any special agreement within ASEAN, but if not you should be able to get your employer to get a Non-Immi O as a dependent.

Myself and my wife are both British. My wife works here and has a Non-Immi B and Work Permit. Myself and our daughter (born here) are both on dependent visas. Our daughter did not have to have a visa until we left the country at 6 months. Please make sure you have the birth certificate original available when you leave Thailand to clear up how your child "entered" the Kingdom.

We were also told by a number of people (none from immigration) that it was OK for our child to enter the Kingdom and overstay. Immigration had a VERY different view on this and were very keen on us getting a Non-Immi O for our little girl.

Alot of people will tell you that a child can come back to Thailand and enter on a 30 day tourist visa, and will not be charged overstay till they are at leas 12 years old.

And that is certainly true, though, as far a I can tell, there is nothing in the written law about this. So it really is at the discretion of the immigration people.

If you want to dot your 'i's and cross your 't's then the best bet is simply to get the non-immigrant O-visa for your child and then their extensions can then ride off the back of the primary visa holder. By rights, if work are covering for visa's and work permits for family members, then that would be the way to go.

Thank you Samran and Draftvader for your advise! You guys helped me with my decision. I think it is better to be safe than sorry. I am going to look into getting a non-imm. O for my child.

A child always needs his own visa, or visa exempt entry. As a Malaysian the child will get 30 days on arrival.

Regarding overstay, no fine is levied for children under 15 yars of age. Best is of course to stay completely legal and get a non-O for the child.

As stated, when leaving the country hhave the birth certificate ready. That explains why there are no details about the child entering the country and will allow you to leave without any problem.

You will need to get the babies non-o while you are in Malaysia.

You will need copies of your passport photo page and your extension of stay stamp. Plus copies of his new passport.
