Dear all

I was wondering does anyone one know if the ukba shows any compassion for a british husband of a thai wife living in the uk become ill with cancer and will be off work for about a year we also have a British born daughter together

Finances are in place to meet new rules

Could we apply for ILR on compassionate grounds

She's been in the UK now since march 2011 currently doing her ESOL course but than runs on until after her visa expires ( may have to apply for FLR first ) I have asked incidentally if she could take her exam earlier at the college I'm hopeful of a reply

Any advice on compassionate grounds would be much appreciated

I am sorry to hear of your illness and wish you a speedy recovery.

Unfortunately there is no exception to the normal settlement rules for foreign spouses in your situation.

You say that "Finances are in place to meet new rules." Note that as she applied for her initial spouse visa prior to 9/7/12 that she will apply for ILR under the old rules.
