Good Lawyer In Pattaya For 30+30 Lease

Hi

I have a house in Pattaya in my wifes name that my father and I paid for.

I'd like to set up a 30+30 year lease and would appreciate recommendations from members of the board for a lawyer that has done this for them.

I hate to say this - and there's lways the exception that proves the rule - but don't you think you should have hired a lawyer BEFORE you and your father bought a house in your wife's name? There are legal ways round the law stopping farangs owning houses. Please be real careful, andif you can transfer the house to a company under your effective control , I advise you to do it.

He did some very good work for me,for a reasonable price. once when I was waiting to meet with him, I heard nothing but glowing reports from other farangs in the waiting room. 'The only lawyer in Pattaya you can trust', and words to that effect.

Not sure about 30 + 30 year leases but two people I would recommend are Pico, an English speaking Barrister - Magna Carta South Pattaya 038 373735 or a legal representative office Smart Angel - Poi, in Pattaya Bazaar. 038 415508 also speaks good English. I have used both and both good and trustworthy.

When you guys say "for a reasonable price", how much approximately would the OP's request cost?

He charged 25000 baht to set up a Thai company, with all the nominee shareholders etc, all documentaion including English translation of every document. Fast and efficient. No idea about leases, I'll ask him next time I see him - maybe next week.

Now the house is in your wifes name. Will she be prepared to sign it over to you for up to 60 years?

does she understand that in a possible future breakdown in your marriage, she would have to vacate her house, possibly for ever.

When you set a lease like this up, there is a fee to be paid to her for it. In my case it was a ficticious 70k for the first 30 years. I think, if she understands the implications of what she is signing for, you may have a job getting her to agree.

I did it that way, on purchasing, right from the begining. When things went wrong and we split, she was round with her family, demanding I get out of her house. Of course, I didn't. That was 4 years ago. Recently, I recieved a note from her demanding rent be paid into her bank account. I showed my lawyer. He told me to ignore it. I have heard no more.

The less she understands about this lease, the better. At the end of the day, you have to cover yourself. I have seen to many men lose there homes to Thai girls. Sorry to be so cynical, but believe me, it's the best policy. She could have you out now, just like that. :o

What many here do is have her buy the land and give you a 30yr lease for a nominal amount. Then you build a house, which you own, on the land.

Jeez guys - you just love jumping to conclusions ? I must be stupid right, because I don't know a good lawyer in Pattaya - not sure why I should when I live in Bangkok...

My wife and I don't live in the house - it's just a place for the weekends, so I doubt she'd be worried about getting thrown out.

My wife is fine with signing the lease - of course we couldn't do it this way from the beginning because the house needs an owner before it can be leased. I've just been lazy in setting it up since we brought it 6 months ago.

Duh - why didn't I think of that.... what makes you think I don't know what I'm doing just because I don't know a reputable lawyer in Pattaya ? We own other properties in Thailand & have representation in Bangkok - I am very comfortable with the lease - much more so than setting up a dummy company. I just need a local lawyer because my Bangkok based lawyer wants too much $$$ for sorting this out - travel time & costs are the big part.

Unbeleivable how you can interpret the 2 sentences in my post into some kind of 'idiot farang getting ripped off' story - nothing better to do ?

Because most of us are idiot farangs who have been ripped off - some many times over. Just looking out for your welfare, and we've got nothing better to do than pass on the benefits of our miserable experiences. So sorry we got it all wrong. Good luck with your lease and your life. :D

In hindsight, Pedro. If you are so sure of your relation ship, why bother with a lease. Just leave it in her name and save your money. :D
