When Do I Have To Leave?

Featured Replies

I handed in my notice to leave my current job when my work permit expires which is this Wednesday. My non-immigrant B runs out at the end of March. My current boss will not inform the authorities that I am no longer working at the school as he doesn't even realize he has to do this, so when do I have to leave? Can I wait until the date my non-immigrant B is going to expire or do I have to leave the moment my work permit finishes? I know technically you have to leave as soon as your work permit is canceled, but as I said, my boss will not cancel it.

If you are not here on an "extension of stay", then you can stay until your visa expires.

If you are currently here on an "extension of stay" for your work, then that expires the day your employment finishes.

(I think there needs to be a pinned topic explaining the terminology around visas and extensions of stay ... maybe in the Important Visa Information topic?).

Whybother is correct.

If you have an EXTENSION OF STAY based upon work (from immigration in Thailand) you must leave the day your employment ends (a 7 day extension will cost you 1,900 Baht from immigration).

If you have a VISA (from a consulate outside Thailand) it is no affected by your employment status and you may use it until it expires.

"I don't want to know why you can't. I want to know how you can!"

I'm not here on an 'extension of stay'. So if a work permit expires and employer and employee do nothing about it, then the employee can stay until the non-b runs out?

My non-B was obtained from immigration in Bangkok, not outside of Thailand - does that effect things?

Yes. It is not a Visa. It is an extension of stay.

It ends the day your employment ends.

If you are on an entry from a non-b visa you can stay until your current permit to stay ends.

If it is a multiple entry visa you can continue to use it until it expires.

Believe you most likely have an extension of stay if obtained in Bangkok. Are you on a 90 day permitted to stay (visa entry) or on a longer (extension of stay for employment)? An extension ends the day the conditions for that extension ends.

The poster is also asking if he is safe to stay until visa expiry, even if the present conditions would require him to leave when his W.P. expires, maybe like, who would know, would immigration know that he was no longer employed if he left the country in March?

It is toss of the dice to stay and just leave without canceling the extension.

Some labor offices notify immigration when a work permit is canceled. There have been many a person that got a unpleasant surprise when they tried to leave the country and got charged for overstay because their extension was canceled.

No one has canceled my work permit though and nor will they

Of course they won't. They don't need to. It's expiring.

Hi...i'm not sure if this is the correct place to ask this question, but the title pretty much summed up what I was needing to know, so here goes...

I'm here on a tourist visa just now as my non imm has expired and I'll be getting married next time round so will replace the non imm with a marriage one, so was only supposed to be one month here on the tourist jobbie. This time though, I've been waiting for a visa to go to Libya (yeah I know...lucky me...) to go to work and its been a while in the coming so I've done two trips to Laos (14 day stamp on arrival) and one 7 day extension at local immigration office thinking that my visa would be here by now. It has been posted out and will be here during the coming week sometime, but the 7day extension expires on Monday (tomorrow) Obviously, I dont want to have an overstay so need to know what are my options - I've been told that the max number of walkthroughs allowed at Nong Khai/Vientienne is either two or three..?? Any advice please?

There is no official limit.

You should be Ok for another one.

LB...thanks for the info. Much appreciated.

I guess I'm not the sharpest knife in the drawer and often the 'expert' advice one hears can be slightly contradictory, so nice clear, concise answers such as yours work for me.

cheers. thumbsup.gif
