Renewing Eos Based On Thai Wife With Small Company

Im looking to change my visa to a EOS based on Thai wife, i would like to go the proof of income route, i currently work for a company who only employee 2 thai staff but have 3 western employees, iv been told from a visa/accountancy firm that the immigration will turn me down when they look at the PN1( think thats the name) and see the thai to western ratio in the company, is that true? i know that we are meant to have 12 thai staff and they have even written on my WP that they will not renew it unless they see tax recipets for 12 staff.

So i ask

1.IS that correct, they will turn me down if i go based on income?

2 Is there anyway around the fact they wont renew my wp unless they have 12 thai staff on the books, is there like a appeal system after all i take care of 3 thai out of my salary (wife, 2 kids) so doesn't that count?

1. depends on the office, they might only look at your salary and tax receipt or the EOS based on having a Thai wife, but if they see the WP and annotation they might want to check that your WP will be extended.

As the extension has to be approved by committee in BKK, they will be strict.

Extending based on 400,000 baht in a bank account in Thailand for to months is another option for the extension.

2. No way around that, but if the company is in your wife's name the requirement for you is reduced to two employees instead of 4. So there is a reduction.

You should not have any problem changing to an extension based upon marriage.

For proof of income you will need to show tax payments for past 3 months for proof of income and work permit to show you are working legally.

Unless you live within the Bangkok region your application will not go there for approval. It will go to the regional headquarters for where you live. Also there is no longer a committee for approval only a higher ranking officer than would be at a local office.

Thanks Ubonjoe. Could you please confirm when the approval process changed? I live outside of Bangkok region but understood that these were still sent to CW HQ for committee aproval.

I have certainly noticed a more strict and pedantic approach this year.

It has been that way for at least 5 years. My first extension then was approved in Korat and that is also when an immigration officer explained to me how it was done.

I have a small stamp in Thai below my extension that gives the date application was received in Korat and date approved. In approved by section it mentions region 4 immigration HQ which is in Korat.

Last year it was approved on same date it was received.
