marry a thai national if you have an old criminal record

Featured Replies

id like to ask what the law is about marrying a Thai lady if you have an old criminal record and then want to stay in Thailand afterwards ive never seen this problem on any site and thought it would be a good question to post

I know there are a lot of shady sorts living in Thailand and i'm sure they have records so how do they over come this problem

and yes I know from experience that they are living there because ive met a few of them in the past and they were happy to talk over a drink about there past problems but id like to see what everyone else think

There's no criminal record check for getting married or getting an extension of stay based on marriage.

You will need an affidavit from your embassy that you are free to marry.

I bet the OP's relieved.

If you are unable to enter Thailand you are blacklisted from entering or have an Interpol warrant for your arrest.

Only visa that requires a criminal record check is the one year non-OA visa for retirement.

well the question would be do you need to be free from a criminal record to apply for affidavit to marry in Thailand

Those questions do not arise. Your embassy askes you are you free to marry, you declare yes. If you are divorced and have a divorce certificate from your country it helps, if you are stating "Divorced".

That should be up to the individual embassy.

My embassy required papers from the magistrates that I was single.

Mine didn't, they just asked for the money in return for the statutory declaration...

It even came with a receipt ;)

Having a criminal record is no reason why you cannot get married and no questions are asked about this. (In many countries you have people marry in prison, but not sure about Thailand).

Having a criminal record can be a reason to deny you entry into Thailand or expell you, but is normally not checked.

I understand that most US States have 'expungement' processes for old convictions. I am not certain if such covers felonies, but the evidence is supposedly not available on a routine search and 'theoretically', only the US Government can open such files. Years ago, I assisted people attempting to enlist in the US Military and handled the processing of such requests, as the US Military can only enlist people with clean records..

Should be a check to see if you are criminally insane. I was lucky I was round the twist long before I married a Thai, but don't doubt I would of ended up there anyhow by now. Still happily married btw, just fortunately as mental as each other. Good luck.
