UHOH! Visa run...

Featured Replies

Heya peeps,

Im an aussie, ive got a non immigration visa type B, double entry visa, which for the non aussies means I get to stay in thailand for two consectuve 3 month periods. A single entry visa would be only one three month period.

My first 3 months is up, and I understand that I will need to leave thailand and return. Because i have a double entry visa already, my understanding is that I dont need to apply for another visa to return to Thailand.

However I am not sure what I need to do, other than just leaving the country and coming back. Do I need to go to the Thai consulate in Cambodia for a stamp or something?

And do I need any documents other than my passport and personal ID?

Also, this may or may not be relevant, I am in thaialnd working, but my contract is short, so I didnt get a fullnlown work permit, however when I applied to the thai consulate in Melbourne for my visa, they required a letter of confirmation from my employer her in Bangkok. Do I need to bring this with me to cambodia?

THanks in advance netizens

You just leave, enter another country and return if you have unused entry and visa expiration date has not passed. You seem to be working illegally however as visa does not allow work without a work permit.

Check your visa, Non-B visas are not issued as double entry.

Should say (S) for single or (M) for multiple entries during one year.

No paperwork needed to bring to the border, just enter Cambodia and return.

Actually there are several Consulates reported to issue non immigrant visas for 2 entries. It is not normal at most but done by some.

Yep.

Consulates get paid a comission on visas issued, maybe this is the reason.

I had a Canadian Consulate give me a one year Ed. Visa, although the contract of study and supporting letter asked for 6 months. (course was 100 hours, finished in 10 weeks.)

A difference of $100. They knew my plans were to stay/retire in Thailand after Thai language school.

They said " As long as you do mind to pay the difference $170 as opposed to $70." I said sure.

How edifying, although completely irrelevant to anything in the thread.

Make sure you go to the border before the 'Enter Before' date written/printed on your Visa, otherwise your second entry will be lost.

Just leave Thailand, entry another country, then you can re-enter Thaland a minute later - done.

Note that you are working illegally if you don't have a Work Permit.

I have seen this visa issued in other countries such as Canada. It is a Business Visa issued as a single or Multiple entry. It does state in the application process that you are required to have the following (not a complete list just a portion of the items required);

  • A letter from your employer stating your position, length of employment, dates and purposes of visits
  • An invitation letter from concerned company/organisation in Thailand stating dates and purposes of visits
  • A copy of concerned company/organisation's registration or license in Thailand

This seems to indicate that you are entitled to work on this visa. Also this visa, as with others can be extended (at immigration discretion) for an additional 30 days in Bangkok.

Just curious if it states you are required to have letter stating your length of contract and employment why the OP can not get a work permit?

Maximum stay is 90 days.

See the MFA list of required documents and Visa issue regulations in the link below:

http://www.mfa.go.th/main/en/services/123/15388-Non-Immigrant-Visa-%22B%22-(for-Business-and.html

Please note section 2.1 (2) (Business Visa to 'Conduct Business in the Kingdom of Thailand') is, according to the MFA, Single Entry 90 days and you must apply at Immigration within Thailand for a one year extension.

The MFA state in the N.B. between sections 2.1 (1) and 2.1 (2).

- An alien who receives a Non-Immigrant visa can work in Thailand once he or she is being granted a work permit. An alien in violation of the Immigration Act B.E. 2522 (1979) concerning taking up employment without work permit or the Royal Decree B.E. 2522 (1979) concerning holding employment in certain restricted occupations and professions shall be prosecuted and imprisoned or fined, or shall face both penalties

So with a Non Immigrant 'B' issued for business puposes you can conduct business in Thailand (presumably look around, meet people, deal with your overseas employer, etc) but cannot work or be employed within Thailand with out a work permit.

What the MFA sees as 'conducting business and 'working' is not so clear; but Thailand being Thailand you had better work on the basis that to do anything that remotely resembles work you will require a Work Permit.

Thanks most of that I understood already.

Jsut the OP stated he/she is "working" and others posted he is doing so illegally. Just curious if the OP's statement of work was actually what is covered under the type of visa they have or is it possible to get a work permit with this visa.

Can the OP apply for a work permit under this type of visa...or would it be denied.

That is the normal type of visa to obtain a work permit on (non immigrant B ). It can be used for business travel.meetings without a work permit or for employment with. There is no routine 30 day extensions of non immigrant visas of any type - that is only for tourist visa entry.
