BANGKOK: -- ATTORNEY General Chulasingh Vasantasingh has been targeted for a criminal probe for alleged abuse of power, Democrat MP Thaworn Senneam said yesterday.

Thaworn and fellow Democrat Wirat Kanlayasiri have petitioned the National Anti-Corruption Commission to launch the investigation.

The two Democrats said Chulasingh could face a jail term of up to seven years if convicted of malfeasance.

Thaworn contends that Chulasingh had no justification for failing to seek a final judicial review on an appellate decision on the 1997 share scandal involving Khunying Pojaman na Pombejra, the ex-wife of former prime minister Thaksin Shinawatra.

Prosecutors indicted Pojaman for fabricating a share transfer to her brother Bhanapot Damapong in order to evade paying Bt273 million in tax.

The lower court handed down a guilty verdict but an appellate review in 2011 overturned the decision on grounds of lacking intent.

The appeal court acquitted Pojaman and her secretary Kanchanapa Honghern. However, it gave a suspended one-year jail term to Bhanapot.

Thaworn said gathering evidence against Chulasingh was difficult and time-consuming.

"I can only file the charge on the last day before Chulasingh retires," he said, explaining why he did not aim for impeachment.

He said he suspected foul play because Chulasingh ignored an NACC instruction to fight the case in the Supreme Court.

Chulasingh also failed to heed a dissenting opinion by the chief justice of the Appeals Court for suspending the jail term, he said.

The lower court did not believe Potjaman when she contended that the nearly billion baht in stock shares she gave to her brother was a wedding gift... given two years after his wedding. :blink:

They rightly sentenced her to 3 years in prison for deliberately defrauding the people of Thailand to the tune of 273 million baht that was due in taxes on the transfer.

An excellent opportunity to finally begin holding the Thai elite responsible for their corruption that directly impinges on the public with reduced tax funds.

Bizarrely, the appeals court agreed with Potjaman's ridiculous explanation.

The Attorney-General fails to follow through on reversing what should be a slam-dunk conviction and the Thai elite are once again not held accountable for their corruption.

Good to hear they want to hold the Attorney-General responsible for not doing his duty to protect the Thai public.

It's one big joke. And the "people" are the ones that suffer.

However, if the "people" continue to be so lazy and/or stupid to do something about it, or simply accept things cos that's "how it is", well that's their look out then. Maybe they will wake up one day.
