krisb Posted October 19, 2013 Posted October 19, 2013 Hi, what's the legal procedure to put a house into our half Thai daughters name who was born in Australia, and my Thai wifes sons name? Ideally I would like some sort of legal contract drawn up that neither can sell the house unless they both agree or 1 could buy the other out. Anyone been down this path or any ideas please?
Daffy D Posted October 19, 2013 Posted October 19, 2013 I'm sure some legal experts will be along shortly. Why not keep the house in your name so you have full control over it while still alive and then the kids will inherit it anyway.
krisb Posted October 19, 2013 Author Posted October 19, 2013 Daffyd, the main issue is if I am going to organise some legal documents in Thailand, it may as well skip to the chase when I can never own the land it's built on. I'm aware of userfruct, 30yr leases etc, but I'd rather just have 1 good legal contract drawn up and that's that. It's about making sure the kids have a nice roof over their heads in the future. Thus wanting to know the procedure for putting this plan into action. I appreciate and understand your post mate. Thankyou. 1
rayongchelsea Posted October 19, 2013 Posted October 19, 2013 How old are they. My understanding is if you put both names on the chanote then one cannot sell without the signature of the other. Then put a usufruct on the deed for yourself. A child cannot be independent of an adult until 20. I can understand you wanting some security for your children but contracts always seem to be open to interpretation I have just recently put the wifes land with my house on it in our two kids name. Seemed to be pretty straightforward the kids had to sigh dozens of papers (if too young a thumb print will do) and it was all done in a few hours. Tried to get a usufruct but for myself but that didn't work Just hope the kids don't throw us out when they reach 20. 1

Mario2008 Posted October 22, 2013 Posted October 22, 2013 You just have the ownership changed and registered at the land office. I believe there can be some extra checks because they are minor and the property should not have any debt on them.
