Permanent Residency - eligible to apply?

Hi!

I want to apply for a Permanent Residency as soon as possible. But I am not sure when I can apply.

I got a multiple entry NON-B 3rd Nov 2008, which my latest entry at 22 Oct 2009, had a valid stay until 22 Jan 2010.
20 Jan 2010 - extension until 22 Jan 2011
21 Jan 2011 - extension until 22 Jan 2012
22 Jan 2012 - extension until 22 Jan 2013
10 May 2012 - MISTAKE - left the country without re-entry stamp. Grrr!!
29 Jul 2012 - entered with a new single e NON-B
25 Oct 2012 - extension until 26 Oct 2013
25 Oct 2013 - extension until 26 Oct 2014
Can apply this year? Or when?

Since the rules state 3 years of consecutive extensions I suspect it will be 2015 because of your lost extension in 2012. If not for that break in extensions it would of been this year.

No announcement has been made yet. Normally you can apply during two weeks in December, so if they announce it should be very soon.

As far as I there is no flexibility. You could with the office at CW that handles the applications to see what they say.

But unless you have already gotten all the required documents you probably don't have enough time to get them for this year.

Yes they have. They did all of them up to 2009 last year.

The 3 years unbroken extensions is one of the most basic qualifications and they have no discretion over that.

You need to marry up three things covering the same period: 3 years unbroken extensions; 3 years work permit; and 3 calendar years tax receipts. Hopefully your tax receipts for 2012 will qualify, despite the broken extension in that year, and you will be able to apply in Dec 2015. If not, you will have to submit 3 calendar years tax receipts covering the period that you also have 3 years unbroken extensions which would mean 2013, 2014 and 2015. Since they open for applications some time in Dec up until the last working day of the year, you cannot submit tax receipts for the year you apply, unless they give you an extension to submit the notarised tax receipt for the current year after applications have closed. I don't think they do this because you can only file for personal tax in January and it can take several weeks for the RD to finalise your case and provide a notarised tax receipt. On the other hand I do know of American applicants who were given until mid Jan to submit their FBI clearances.

The cabinet resolution setting the standard quota of 100 per nationality and 50 persons for 2013 applications was announced in the Royal Gazette in, I think, September and Immigration could open for applications any time between now and the end of the year. I think some of the backlog from 2009 and maybe some from 2008 are still waiting approval but, as far as I know 2006 and 2007 were completely cleared in 2012. In 2010 they didn't open for applications. I haven't heard of anyone being approved from 2011. A friend in that batch was told his application is on the minister's desk, whatever that means.

If you have any uncertainties regarding your application, it is best to take what docs you have to Immigration and ask for their opinion before you commence the big job of obtaining notarised documents and police clearances. You ask for the section that deals with PR and they are usually very friendly and happy to give an opinion.
