So, my husband and I have been married 7 years now. He is a Thai national who now has dual citizenship (Canada). We have been living in Canada for the past 4 years and are moving back to Thailand. We have a 3 year old daughter who is also a dual citizen of Canada and Thailand.

My husband wants to adopt his nephew. Classic Isaan story: Dad worked in factory, met mother, had two kids, split up, Grandpa raising him while Dad still in factory.

Here is where things get tricky. As far as I am concerned it will be easy for my husband to adopt his nephew as long as both parents consent; but what happens when we tell the Canadian Embassy?

Can we then just apply citizenship for him?

If you want to adopt him it can be done in two ways:

1. a Thai adoption, which is relatively easy but might not be accpeted by Canada. in other words, the child may not aquire Canadian naitonality as a result of an adoption.

2. An international adoption, to bot the law of Canada and Thailand. That will be more difficult and costly, but the child might acquire Canadian nationality as a result.

Since you don't have Thai nationality the Thai authorities might insist on an international adoption anyway.
