Is child overstaying in trouble?

Featured Replies

Hey guys,

as children under 7 are not subject to fines, I did not bother anymore at some point to extent my daughter's (3 years old) tourist visa.

(I have a work permit though).

Will we be in trouble when leaving the country? Even if they cannot fine her, will she get a stamp or anything?

Thanks!

M.

She will get a stamp in her passport.

It wont be a problem though

No you and she will not be subject to any fine (age is through 14 I believe) but they may stamp passport as overstay (but that will not have any effect on new entry).

Children under the age of 15 do not pay overstay fines. They do get a stamp put in their passport for the overstay. They might give you a lecture but there will be no problem.

If you are on an extension of stay you could of gotten her an extension as your dependent. While you out of the country you should get her a single entry non-o visa so that you can get the extension for her.

I don't understand your philosophy.

Because there would not be a fine since she was a minor, you didn't bother following the rules. Now you're on TV asking about the consequences?

Sorry mate, that's just silly.

Well I don't follow the rules either. Shoot me!

I have left the country twice with my son both times there was no problem.

Why spend 4000 baht if you don't have to?

I would have thought that if you are the legal guardian of the child you would be held responsible & a fine would be your responsability.

Is she a luk khreung? Why has she not got a Thai passport? Not Thai, maybe?

There is no fine for children and immigration officers often will advise to just overstay in such a situation.

A friend of mine arrived with his wife and their then 3yr old (blond) daughter. The little girl had a double entry tourist visa in her passport.

The Airport immigration officer said " Next time no need visa, baby can have 30 days entry and stay long time , no problem! "

It is not a problem with immigration. For short term stay is should never be a problem but for longer stay I recommend do it the correct way,

As the child get older and it is time for them to go to school is when problems can arise. Many schools will want to see a valid permit to stay by way of a visa or extension of stay.

Sure , I do understand and appreciate the point!

I was just illustrating the immigration officers benevolent attitude towards children. The little girl featuring in my anecdote was of course completely "legal" with her own visa !

12yo boy on overstay since arriving at 9 months old....left a few times, but never a problem really except one time some cow gave me grief and I ignored her.

Been to school all that time too....not an issue.

Don't waste money in this country if you do not need to.

I know....I'm a bad mother...

I guess I just wanted to be sure. I could still take her to Myanmar and rather argue with people at the border than being bothered right before I have to catch a plane.

But if you say, it's no problem - and she is blond ;-)

Thanks!

Make sure the child has all necessary visas ect. for the planned trip. Every country is not as generous as Thailand !

For a child until the age of 15 it is not a problem but the passport will be stamped.

It is not a problem for Thailand but it can cause a problem when traveling to other country's.

America is known of refusing entry for people with overstay stamps in their passport.

Their opinion is if you overstay in another country you will probable also overstay your stay in the states.

Thanks, I am aware of that, and she has a second (american) passport that she can use.

I also could just get her a new one and everything will be cleared right?

No...cos they still have records of when she entered...

Just don't worry about it, it is a non issue here.

And as for the overstay issue with other countries...yes maybe for adults with stamps in their PP...but not little kids.

US immigration would not deny a US citizen entry for having an overstay stamp. Info posted is for those that are entering the US on a visa

The new passport should be gotten abroad, otherwise details of the old pasport must be transferred to the new passport and I am not sure how immigration will handle that in case of an overstay. It would of course include the overstay, which will be stamped in the new passport.

A new paspsort will not mean that it is cleared, it will still be in the immigration records, but he important factor is that other countries cannot see the stamp that one has overstayed.
