I've overstayed my visa quite some time and need to leave and try and get new visa to return. Will I have a problem getting new visa if I go out pay overstay fine and attempt to get new visa at Thai embassy say in KL? Or should I get a new clean passport?

I don't think Kl is recommended at this time, but pay up as you exit and try someplace, the fine is 500 Baht per day and tops out at 20K Baht. If you get refused, just try someplace else. You shouldn't have any problems, but I wouldn't blame them for instituting a penalty period for serious over stayers.

What nationality are you? How long is the overstay? Why? What is the history in your passport? Why aren't you telling us more?

Usually people with a long overstay come on this forum and tell their tale of woe. Unfortunately, there are some who come along without any helpful advice and only want to slag them, but normally I'm not one of them. I've helped many elderly, ill people on overstay, so I have a fair amount of compassion. But, I'm blown away by the matter-of-fact attitude of the OP about his overstay. Maybe it is time to set up an OVERSTAY forum on ThaiVisa.Com as some have suggested.

Likewise I always find it incredible.

Anyone who is subject to the full fine amount of 20,0000 Baht and who hasn't been Hospitalised should have a 2 year exclusion period put on them and if repeated, permanent exclusion.....

Right tin hat on but I never understand how its defendable............

What's the problem with KL? Anything I should know?

KL will have an embassy, as opposed to a consulate.

Many consulates are run as businesses collecting Visa fees, especially in the case of Honorary consulates.

Your chances of getting what you want from a consulate are much better than an Embassy which will generally more strictly apply the rules.

It;s a long time since I had to get a visa in a neighbouring country so maybe other members will have more specific advice.

You know, the specific advice I usually have for the people I assist is to return to your home country where you can avail yourself of the safety net put in place by the taxpayers of the country that have an obligation to care for you.

Merely being present on Thai soil doesn't entitle anyone to free medical care in Thailand. You have to work and pay into the Thai health insurance program.

How's that for specific advise?

Yes, you may have a look in the Pinned Topics Section, or on these pages, I think some applicants complained of being asked to meet additional requirements, and being denied a visa. It may pay to know what's going on, before you plan your trip.

Just for the record I had health issues and financial problems . I've been I'll for more than 9 months and over stayed here by that length of time. I'm 57 years old. Not so old but not young either. I asked this question as I'm not used to being in these situations as I normally dont end up like this. I am seeking good sound advise and I'm not in the habit of overstaying my visa. Its a first for me.

It would be best to arrange a flight out and pay the overstay at immigration on departure. The fine will be 20k baht.

You will not have problem getting a visa. Since you are over 50 getting a single entry non-o would be better than getting a single entry tourist visa.

KL is not on my recommended list for any visa. They lack consistency for the issuance of visas going by the reports I have seen.

Merely being present on Thai soil doesn't entitle anyone to free medical care in Thailand. You have to work and pay into the Thai health insurance program.

Am speaking politely but of course it affects every single one of us regarding Thailands attitude to Overstay..........If no one overstayed than perhaps Thailands attitude to immigration would be slightly less stringent and people wouldn't have to jump through hoops to obtain certain Visas.....

Thats only my opinion but again how can anyone defend overstayers not hospitilsed with full 20k fines, so the true overstay likely to be a sight longer

But again what does that have to do with you? If the OP decides to overstay then that's his problem not yours

This is total wrong I for one get Free medical I do not work but have lived in Thailand for over 10 yrs I can go to any medical hospital cost me nothing if this is right or not I don't care but the advice from this person is wrong. I am Australian, and I agree with the above post keep your nose out of peoples business.

Since the OP says he's 57 years old, he's young enough to be able to obtain private health insurance in Thailand. I would hope he's planning to do that since it seems he's going to return to Thailand soon.

As for the previous poster, his situation is unique. It's great that he has free medical care here, but few foreigners do. Obviously the OP doesn't, or he wouldn't be asking us how to fix an overstay.

Actually, I don't think Thai people have "free" medical care, either. Don't they pay 30 baht?

And as I said -- I've helped dozens of elderly expats who had medical problems and ended up on overstay. Anyone who tells me to "keep my nose out of other people's business" isn't aware of the experiences I've had. I think I am in a position to offer specific advise to a relatively young man who finds with a problem that can be avoided. Most of the men I've assisted are simply way too old to purchase private health insurance at any price. The OP is not.

The UK issues a emergency travel document with several months validity for them.

Do you have a visa or extension of stay from immigration. There is no minimum passport validity requirement to get an extension but the extension will only be valid for the passports validity.

Hi guys,

I wanna tell you about my story here and i hope you can give me any advice for my problem about overstay in the kingdom. I am working her in Thailand and i do have a permit for 1 year and also a working permit to work!

So this is my story, I still have a valid working visa and a stamp on my passport for like 6 months, and when I travel outside the country and back my remaining visa is not valid anymore! its because I don't secure a re - entry visa. So i was shock when i show up in the immigration office they said my visa is not valid anymore and I'm A OVERSTAY here now for 6 months! and I'm really scared now and freaking out what should i would do! Im ignorance about re-entry I know guy!?

My company now are still processing my documents for re-applying the non b visa in Penang and Ill pay for my overstay in sadao boarders. for like 20k baht!! Now i want to know if there any restriction as the moment in penang or sadao boarders and is it easy to just pay the 20k baht for penalties and good to go malaysia penang and process NON B?

Im begging for a good advice here guys hope you can help me!

You apparently had an extension of stay from immigration not a visa. A re-entry permit is need to keep an extension valid.

You should of noticed you had a problem when you entered the country and only got a 30 day permit to stay. You must not of been making 90 day reports to immigration or your problem would been noticed before 6 months elapsed.

Unless you are caught on the way to the border you will not have a problem paying the 20K baht fine when you leave.

However im preparing all my documents with the company papers to process the non b to penang and pay the penalties to sadao. Any updates anyone if safe to pay at sadao and safe to process at penang for non b at the moment besides of cracdown?

I am not sure what you are telling here.

But if you have a stil valid visa entry and they just gave you the wrong stamp, you cna have it fixed for free at immigration.

If the stamp is correct you can go to Sadao and pay there. leaving by air is normally advised, as at the airport they don't want to delay you and miss the plane.

He had an extension of stay and left without getting a re-entry permit so he only got a 30 day visa exempt entry when he entered.

As I said before he can leave pay the fine and get the non-b without a problem. The "crackdown" is not rated to his problem.

Correct.

If you already have a valid work permit you will not need documents from the work permit office.

Hello Everyone,

Is anyone here can help me? I would like to ask if you can give me any advices of what to do about my situations. I am ready next week to surrender to Thai immigration office in sadao borders and going to penang.

I am overstaying for 180 days and counting with a long story to tell. My company gave me 20,000฿ for the penalty of overstay and all the documents that i need to apply a NON B VISA again to penang.

Now I want to know and to make sure that Thai Immigration Officer wont drag me to jail when I surrender. Do I need a plane ticket back to my country? Before I go to Thai Immigration Officer? Or I dont need a plane ticket because I will exit to penang Malaysia and apply for a new NON B VISA.

And If I need a plane ticket back to my homeland what do you suggest? phuket airport? or just i. penang? back to my homeland.

FYI: I a. legally working here in thailand I do have a working permit and Visa but suddenly my visa stamp on my passport now is invalid because i dont secure a re entry permit when i travel outside thailand.

Any updates for restrictions in sadao borders? and going to penang?
