Am living in Thailand now for over 15 years but have always been here with regular entry stamps and Tourist visas. My last Visa was a Non-O visa.

I have done this as I have always been working off shore for 4 months on 2 months off schedules so never actually had the need for long term visas.

Now this time around I will be leaving for one more contract out and will return in September with the idea to have my own business set up in Thailand.

I was advised to apply for a Business Visa but have no clue on how to proceed.

I am a Belgian national and have a 13 year old son in Thailand who has double nationality though am not married with the Mother though this would not be an issue and actually be in the plans anyway when I settle more permanently here in Thailand.

So this week I will be leaving for Brisbane Australia for one more 3 month contrat

Now what would be the best procedure for me to proceed to obtain this Business Visa?

As for set up of Business I will be doing this together with a partner so the set up of the company is covered for from within Thailand while I will be finnishing my last contract abroad.

If you were able to get a non-o visa based upon having a Thai child you could get a work permit and work. You could also get an extension of stay based upon having a Thai child if your parenthood has been legitimized unless you were married to their mother previously.

Getting a non immigrant B visa would be difficult to get until you have your business set up and you have a work permit.

though business will be set up while away and will be finalized before or at the day I get back

If you plan on getting the B visa from any nearby location you will not be able to get the B visa without a letter of approval for a work permit application.

Once you get the business set up and have your work permit you will only be able to get multiple entry non-b visa for at least 1 year because the rules for an extension of stay require tax records for one full tax year.

Isnt a Non Imm B always a 1 year visa with a 90 day rule in place?

The idea would be to have the company set up before I apply for any visa.

I would enter the country on a stamp or would it be advisable to request for another Non-O single entry (90 days which I can get based on my son) to start with?

As soon as company is set up work permit request is filed and after I would apply for Non-B multiple entries

I would get the single entry non-o so that you can apply for the work permit (include you child's birth certificate with application). Dependent on the work permit office you have to use they should also issue the work permit. With the work permit you could then go out for the non-b multiple entry visa.

Without a non immigrant visa entry you would have to make one trip out for a non-b visa after the work permit application is a approved and then again for the multiple entry.
