Ok I have another question….again. This time is regarding “a work permit”

Below is my dilemma

I’m a licensed structural engineer and owned my own firm here in the US for the past 15 yrs. In a few months I will be in Thailand on “marriage visa”. I’m planning to keep my company open in the US but as for myself will be doing some of the works from Thailand – at home. Oh I’m under 50.

My questions…

1)Do I need the work permit in order to work from home in Thailand, eventhough I will not be serving any thais, but only US base clients?

2)How can I get the work permit, when my profession is one of those prohibited works in Thailand?

The thai structural engineers absolutely can not do my line of work for the clients in the US because all structural drawings hard copies/print outs must have a wet-stamp w/dated & signature of a professional US-licensed engineer before going through the building permitting process in the US. All the project locations will only be in the US.

I very don’t want any problem with my first 1 yr extension regarding a work permit. I have heard the immigration officer will want to visit you at your home also and sure they will see my large format/blueprint plotter. What will happen to me and will I get deported?

Can't really tell you about your situation , but honestly i would go to Sunbelt (one of our Forum sponsors www.lawyer.th.com ) and let them help you . They are legal advisors and have experience, never heard anything negative about them.

The usual answer for one in your position would be to keep quiet about what you're doing and operate under the radar, you're not taking work from Thais.

The problem is, that to get a work permit you need a company with all it's problems and costs, it's no problem to start a company as one of the prohibited professions if you are a 'consultant'.

Indosiam or Sunbelt can advise you on the costs involved.

Personally I'd go with option 1 (under the radar).

Immigration don't visit everyone and if you get a multi entry visa, you won't need to worry about it for 15 months, lots can happen in that time. I'm sure you can bluff it if the man asks about the plotter (if he even knows what he's looking at), keep it in the spare bedroom :o

We called to asked the Thai Labor Dept and they stated "No need to have a work permit in this case"

Asked also about the Immigration officer visiting the house and seeing the format/blueprint plotter. " No problem. This is not proof he is working anyhow"

It is a refreshing sight in todays commercially oriented world to find a company like SunbeltAsia who give their time and advice freely. Sunbelt could quite easily have said contact us and we will look into it for you. But instead, made 'phone calls and posted the answers here, saving the OP money.

I will feel much better if I have reaffirmation in writing from them in my hand. Just don’t want any future problem during the 1 yr extension process.

Can I do this while still in the US or do I need to be in Thailand first? I will be applying for non-immigration visa soon here.
