I have done quite a lot of reading on TV regarding getting visa based on having Thai child (now baby is 18 months). I am with the mother (happily for a few years now) but still not ready to get married. I have also just been through court process to get legitimization 'paper' to be recognised as legal father in Thailand and hopefully will receive this next month. I would appreciate from TV members who know for certain (100%!) any feedback for the following questions:-

1. My preferred option would be a Multi O due to nature of my rotational work outside of Thailand. I realise these are hard to get now but does any TV member know of anywhere these will definitely be issued based on having Thai child? I had read the poster that went to Malaysia and was successful but not sure if this was 'normal' procedure?

2. If Multi-O is a non-starter then I realise that a single-O with multi-entry stamp is the second route. I had initially received a Single-O a while back, got the re-entry stamp and then an extension while the court process was taking place however it has been a bit longer than I thought it would so this has run out and next time I return to Thailand will be on an exempt 30 day. If I get another Single-O (prob in Savanakhet) which shouldn't be a problem and then return to Bangkok (CW) where I will try to get year extension I would appreciate clarification on following points:-

- Does the money (400k I believe) have to be seasoned for 'x' amount of months in Thai bank? I have read a few posters that say this doesn't have to be however on my last visit to CW immigration, the officer (I think) said that this has to be in my bank for a few (3?) months?

- If I decided to get letter of income from (British) embassy, would a letter from my employer be suffice as proof or would I have to bring bank statements from my overseas bank account that this is paid into?

- Asides from the normal docs needed to obtain 60 day extension of stay previously, and also now the court paper for legitimization and bank statement (or) income letter from embassy - is there anything else I would need?

Any other advice greatly received.

You could get a multiple entry non-o in Savannakhet after you get the legitimization documents. They have issued them when the father, mother and child were together at the consulate and demonstrated they were living together as a family (de facto marriage).

You could get a single entry non-o visa and apply for an extension of stay based upon being the parent of a Thai. You could get a re-entry permit if you needed to travel before you could apply for the extension during the last 30 days of your 90 day entry from the visa. The problem you may have because you are on a rotation is being here during 30 day under consideration period after you apply.

The 400k baht only has to be in the bank on the date you apply. In your case the embassy would have you do a statutory declaration for your income since you are not applying for a retirement extension. I believe they will accept a letter from your employer for the proof of income.

Thanks Joe for quick reply. Just to clarify, if I went the 400k route is my bank passbook with updated amount suffice or do I have to get letter from my bank branch detailing amount etc. and also how recent would this have to be?

Furthermore, would the 400k in bank be Ok on its own or would I need to show proof of income as well?

Im not sure about bringing the baby to Savannakhet due to all the travel / getting there etc. If I did, do Savananakhet embassy require 400k proof as well?

Do you know if the London embassy would issue Multi-O for this? Im planning to bring GF and baby back for month in March to UK? If so would they require same docs / money etc?

You need updated bankbook and bank letter, letter preferably not older than a few days (but depends on the immigration office). At CW most banks have a branch where you can get the bank letter and update the bank book.

If going for the money in the bank option, no income needs to be shown.

Savanakhet de not require proof of finances.

You would only need the 400k baht in the bank not both. You would need a letter from the bank and copies you your updated bank book, CW prefers the letter on the same day you apply because there are branches of most bank in the basement there.

Savannakhet does not ask for financial proof. You can fly there. Nok Air and Air Asia both have flights to Mukdahan that are a fly/ride service via Nakhon Phanom.

The embassy in London does not ask for financial proof either. They seem to be reluctant to do non-o's based upon being the parent of a Thai. You would have to contact them to find out their requirements.

Just a side question about the 400k in a Thai bank account? Does this money have to be transfered from outside thailand? My situation is that I have the 400k THB but in sum of two bank accounts. The money in these bank accounts have been deposited inside thailand.

There is no requirement for the funds to come from abroad.

The only time proof is asked for is at Bangkok immigration if you are applying for a conversion to a non immigrant visa.

You child will not need to be with you to apply for a visa.

You will need their birth certificate plus a copy of it and a copy of their house book.

That is all you need. No financial proof is needed. A single entry visa is easy to get.

I am not married and my son was born in Bangkok from Thai mother. He is now 15 years old. I am also working sort of offshore, by contracts in different countries everytime. I got such visa then from different Thai consulate, depending where i was located for my work, Malaysia, Vietnam, Singapore, Russia...Note that I have a French passport. The last 2 non O 1 year multi entries i got was issued by the Thai consulate in Yangon as i am currently working in Myanmar.

To apply, i provide:

- introduction letter addressed to the Consul explaining my situation

- copy or original (depends on the consulate) Thai Birth certificate of my son

I always also prepare a copy of my working contract or bank statements ( Thai or not) anything that can show my regular incomes but it has never been required. Just in case...

Some consulates stated in their website or communication that they are not issuing 1 year visa or multi entries such as Yangon but when i told them that i got such visa in the past from others consulates, they then issued 1 year non o multiple entries.

1 year non o multiple entries cost me 200 USD

Can you please provide a link to this information? I'm on an ED visa now and just had a son and would like to get a visa based on caring for him. Is there someone I can hire to help me do all this?

You might need to hire a family lawyer but for me I didn't. I am not expert about visa's, just my experience according to my situation.

My son was born in Bangkok and both of his mother name and my name were put in the Thai Birth Certificate. My son also using my Family name, not his mother family name. When I divorce few years later, it is written on the divorce certificate issued by the Amphur that I have 100% of the legal right for my son. I used a lawyer for the divorce and asked him to make sure that I have the legal right for my son.

As for the visa Non O based on child, as I mentioned in my previous post, it seems to really depends on each Thai Embassies. The first time I applied for such visa, I prepared a nice introduction letter to the attention of the Honorable Consul, explaining my situation and that I would be ready to present any justification needed. They just asked me to provide a copy of the Thai Birth certificate of my son and they will issue the visa. Another consulate was asking me to present the original Thai Birth certificate while I was presenting only a copy. In Yangon, when I called the Thai Embassy and inquired about this visa, they told me that they were issuing only 6 months visa. After explaining that I got in the past several 1 year multi entries from other embassies, and that I am currently based in Myanmar with a Myanmar 1 year business visa multi, then they issued a 1 year multi Non O based on child for me.

Your case is different because you were married to you child's mother which makes you the legal father of your child.

If not married to the child's mother it requires the fathers parenthood be legitimized to become the legal father.

I met with the attorney today.. First he wanted 20,000 baht (15,000 + 5000 to get 'expedited' court service.) I quickly said normal time is fine. He really tried to sell me on the quick service. Anyway, it seems like a sign and stamp type of operation if both parties are in agreement. No DNA test is required and it should all take about 50 days. (30 days was expedited).

Anyone have the latest on which embassy to go to for a no hassle visa? I have been to Vientiene and I thought it was okay. Maybe a city a little more interesting? Ho Chi Minh?

I was able to get the Visa with a minor problem. I forgot a copy of my wife's ID and they also wanted a copy of her families book. (Her mom and fathers). They lady was nice enough to stamp me as I did promise to bring them the next day.

Anyway, I believe I have two more weeks to wait until I receive the legitimization documents for my son. I have a little less than 30 days before my visa expires. Should I go to my immigration office before and explain the situation?

I'm going for a one year extension.

So it's all the same documents PLUS the legitimization documents? (Typically? ) Does my gf/sons mom need to come with and bring anything?

If you don't have time to get the one year extension you could apply for the 60 day extension to visit your child. Then do the one year,

Best to ask your local office their requirements to get the extension based upon being a parent of a Thai.

You will need the financial proof mentioned earlier in this topic.

It would be best if you child's mother was with you.

just got some info on this same topic While in Penang today getting a 60 day tourist visa.

While paying the fee to the guy doing the visa service for me I picked his brain an asked.....

What is required? Can I get a Non Imm o visa to be with child/family unmarried and over 50 from Penang consulate?

His reply very positive yes.

Items required to get a 1 year multiple entry Non Imm O visa to be with child from Penag are as follows.

1=2 Photos with application form filled out correctly and fee of 550 Malaysian ringit

2= Child's Original Thai birth cert with translation (Fathers name must be on birth Cert with matching surnames)

I asked him about the legitimization of father/child issue and he said no problems as long as my name on original birth cert matches my childs.

3= This the main thing he said...show a Thai bank Savings account/bankbook in my name with at least 200K or more in the account he said QUOTE: The more money in the account the better he said nothing about letters from employers embassies just A SAVINGS ACCOUNT IN MY NAME OVER 200K CASH IN THE BANK ...

4= Need all forms of ID with copies of Dad Mom and child ID's passports id cards and house papers etc

That was about it so hopefully in 3 months when my new 60 day plus 30 day extension runs out and can get some cash in my savings account ..I can apply for the 1 year visa as above mentioned.
