ED Visa (Cancel) to Non-B with WP Option

Featured Replies

TVF Help and advice please.

I have trawled the info here and with some much confusion, I would just like to be sure before I undertake an expedition to gain a visa.

I have a UK passport. Not old enough to retire (I have cash but too young) and am married to a Thai. I came two years back on a triple tourist visa, then moved to an ED Visa, this expires at the end of March. Am on Samui and grateful for any advice as to where best to gain the visa I need.

My wife already has a teaching company, I have all the quals to teach. She has done all the necessary to employ me via her lawyer, I am employed at 50,000 thb per month etc. We have all the company documents, tax etc. I don't yet have a Visa or WP. The documents from the lawyer states I will apply for a NON-B Multiple Entry.

Couple of questions If I may,

I have to cancel my ED Visa, my school say's they need 1 month's notice, can I speed that up in any way by doing it myself? or do i just exit Thailand to cancel it?

Can I get a NON-B Multiple Entry from Khota Bharu? The local 'Burger' run (company in Samui) website states I can only get a single entry from Khota Bharu? Anyone any luck with this? Is Vientiane any easier?

I don't have a WP, but have a receipt in readiness to collect, the lawyer told me to collect it after I have the visa, is that the case?

I am aware I can get a marriage type visa and also a WP. This is not our preferred option.

Grateful in advance to all.

You will not be able to get more than a single entry 90 day non immigrant 'b' visa in this region and that 's with all the MFA required paperwork.

KB should be ok, but best check before if they are asking for the 'Letter of Approval' from the ministry of Labour, must now request this in addition to the WP Successful Filing Receipt.

Get the visa, 90 day entry then go back to Labour to collect your WP.

You can then get a one year multiple entry non immigrant 'b' visa in Penang with 8 month or more remaining validity on your WP and possibly also KB.

You may well be also eligible to apply for a one year extension based on working in Thailand at Samui once you have your WP and within 30 days of expiry for your 90 day entry (if you apply there take the 1,900 THB in an envelope marked' fee for one year extension, other wise they will try and sting you for 5,000 THB!)..

Penang is a great place to visit for a few days, however KB is very, very, Islamic and can be somewhat of a culture shock.

Don't bother with KL they have become a real pain over the last two years.

Why not get non-o visa based upon marriage to a Thai. You can get a work permit and work with it.

You could then get an extension of stay based upon marriage by proving an income of 40k baht by way of tax payments.

This would certainly be the easy way to do it.

There is no requirement for you to cancel you ED extension to get a visa. You extension ends as soon as you leave the country.

Thank you gents,

Very helpful.

Back to lawyer to consider the marriage way. I thought it was just a rumour about WP with marriage and yes, agreed, 40k via tax payments should be easier than contacting UK for financials and proofs etc.

Lastly, more thanks, exiting automatically cancels ED visa, that is great. Do I need a letter from school also?

Thanks again,

Brilliant pointers.

It is certainly not a rumor about working with a non-o visa or extension of stay based upon marriage.

The letter from the school will not be needed since you will not be leaving the country at Nong Kai.
