Hey there guys, long time lurker, first time poster.

I've had a hectic and scary morning. Essentially I got into an argument with my employer (I work at a school), and left the school. They told me the standard stuff, that I wouldn't be receiving pay etc, but the scary part was that they told me they was going to go to immigration to cancel my Non-B visa. Is this possible?

My Visa currently looks like this:

Says Non-Immigrant B

date of Issue 10th January 2015

Enter before 9th April 2015

A big blue USED stamp, dated 11th January 2015

On the top of the visa a stamp stating... "Remark: The applicant is advised to apply for a work permit which should be presented to the authorities next time".

I'm sorry to bother you guys, and I imagine this kind of stuff is asked on a daily basis, but I have had a terrible morning and I would really love an explanation as to what I have to do. If it can be cancelled, I should go to my local immigration, cancel the visa myself and ask for a "day day grace period" for 1900 baht, and then work on getting a 60day double entry visa right?

The school was working on me getting a work permit, but I never gave them the photos they required to continue the paperwork. When I went to Laos to obtain the Non-B visa I deffo took some paperwork the school provided me with details of the school and such.

Does this mean in fact that I have a visa extension based on a work permit?

You are ok and have 90 days from when you entered - I did a similar thing last year

The school cannot do anything as you don't have a visa extension based on having a work - if you did it can get complicated if you left a school on bad terms

Until your 90 days ends you are 100% ok

The red stamp means you need to get a work permit - for example if you went back to Vientiane for another single non-b using the same documents and school your application will be rejected - the main reason being is that you are meant to apply for a work permit during the initial 90 days and get an extension

Going back to Vientiane with documents from a different school no problem

Your best option is to try and arrange a contract now with a new school and get a work permit, then extension

I was threatened that i would be deported and i have a ed visa if i left my contract a week early. The agency dont want to lose face and are scared of not being paid that month. Funnily enough the contract states on every page its not bound by thai law. Im sure they cant do anything.

You must make decisions based on what you believe to be the best course of action.

The Thai labour law takes precedence over any contract you sign.

You will be able to stay for the ninety days, nothing the school can do. You could find another school and get them to arrange a work permit on your current visa before it expires. However, they may be a bit iffy about giving you a work permit on the strenghth of a visa with a different school named on it. (not sure about this).

If not just get fresh papers from your new school and go and get a new non-b.

Not trying to be an a$$, but you only lasted 5 weeks.

What was the big issue?

Hopefully you have a finger on the problem and everything goes well with the next school, but teaching here can be a nightmare you need to be prepared for.

Hopefully you have a finger on the problem and everything goes well with the next school, but teaching here can be a nightmare you need to be prepared for.

I was working there for a while on a double entry visa before I received the Non-B, so a bit longer than 5 weeks! Got into an argument about summer school and kindergarten stuff, kind of petty really. I feel I could have deffo managed it better, but I see the whole thing as a learning experience. This was my first school in Thailand, and I feel much better prepared for when I go into my second.

Yeah you are right. Today was a shock for me, I was very unsure as to if the school could or could not take the VISA away from me. I'm glad I am good until April. Thank you everybody on Thaivisa.com for being friendly and helping a lad out when when I wasn't sure where to look for help.

When you applied for the non-b that school is mentioned on the visa but it makes absolutely no difference to what Ubonjoe and myself said earlier.

You are not on an extension and the school cannot cancel the original non-b visa whilst you are on the original 90 days

Your fears are groundless, the school (no matter how influential they may be) cannot cancel a non 'b' 90 day permission to stay.

It is standard practice for an institution's name to be written in with a 'b' visa which is obtained using a school's papers.

They will go as low as they can to get u to stay. The agency will not get payed that month for there commison for that month and will lose face and might not get the contract for next year because of your actions. But really who cares.

Curious, was this a school or agency? This is when ironically agencies are from what I've seen better to deal with - for payment. Agencies have no illusions that you will not work for free. A school, like a child will assess its needs and then want to take your time without compensation. Whether it knows and stong arms you or just think its all part of the job (you working for xxx hours free)

You might want to leave and return just to make a clean break of the school before you look for work again. There will be no lingering issue when applying fir a new job.

Thailand really needs to regulate all the teachers and schools, replace the agencies. Create a special license for teachers with quals and from proper colleges and universities. Create a board for issues and resolution. Background check from home as well as verbal check from students for any creepiness. Create a pool of certified applicants that can teach forever in EFL.

Maybe you could have handled it better, but no doubt they asked something ridiculous and over the top. Disrespect. Lots of disrespect in that industry.

OP, just do yourself a favor and go to Korea what are you mucking about here for? That window will close soon. You are just wasting your life away.

Thanks for this input. Remember I said I did not know well. My fears were just that as they say here the Thai is always right and when they threaten him about cancelling his visa made me so worried and I was thinking that maybe his school could do everything possible to cancel the visa since it bears their school name. I just hope that they don't have the possibility of doing anything like that.

An entry from a visa can only be canceled by immigration deporting you for a serious offense under the immigration act or a crime.

An extension of stay can be cancelled because they are based upon working or some other reason. If that reason goes away the extension goes away.

It's perfect timing to look for the next one. You will find all the arguments are petty!

Hard to get used to, but when a kid asks if he can come talk to you for extra practice outside of class hours, very rewarding as well.
