Permanent residency when under BOI work permit

Featured Replies

Hi,

I have been living and working with regular work permit in Thailand for 7 years with uninterrupted extensions of stay. I speak, read and write Thai. The last 3 years I have been employed under a BOI work permit (board of investment). The company I work for is a Regional Operating Headquarter.

Apparently immigration officers told my lawyer that the fact that my employer is a Regional Operating Headquarter (ROH) will make the procedure for PR much more complex and longer (probably around 5 years).

Furthermore, the tax benefits under BOI are not favorable for my application.

Is this nonsense, or can someone direct me to a different lawyer that can help?

Thanks!

There should be no difference in the time required to get PR. Most PR applications are now taking several years..

You do not need a lawyer to apply for PR.

A lawyer will not do any good, as you will have to get all the required documents yourself and also need to do all the interviews yourself.

The companies tax documents are not much of an issue, your own tax documents are.

I suggest you contact the immigration section that deals with PR directly.

Thanks both. Actually I thought having a lawyer makes it easier?

Not "easier" just very expensive !

I have some information that may be of interest. I was granted my PR in March of 1996 and had applied for a 3 year BOI visa. The BOI visa came in two weeks after I received my PR. So, I asked my employer what to do about the 3 year BOI visa? I was currently on a Thai marriage visa. He (a company lawyer) said just leave it at the BOI and it will be invalidated automatically at a future time. The company (Shinawatra Satellite) work permit was still only valid for one year at a time. In my opinion, having a BOI work permit has no bearing on your PR application. By the way, I did the whole PR process by myself.
