Hi,

We live in the USA, but are UK citizens.

My wife (Thai/UK nationality) will take our kids to Thailand to visit her parents across the summer (kids have UK passports)

They are going for 64 days, which rules out a tourist visa.

I am going to apply for an O visa through the Chicago Consulate. They have been vague on the phone as to what documentation to send in, and the application doesn't consider it from a child's POV.

What documents should we be sending?

If the kids are Thai why not just get them a Thai Passport?

If not a double entry Tourist Visa.

Why attempt to "over-think" and complicate a simple issue?

Also ! A tourist visa is valid for 60 days and can be extended on application at an immigration office for a further 30 days at a cost of 1900 Bht

NB

I do not believe there is any basis upon which the children would qualify for "o" visas .

It is not quite so simple:

1) The missus doesn't want to get them a thai passport (military service, commitments etc).

2) extension of a tourist visa is a hassle as they will be upcountry 100s of miles from an immigration office.

3) The duration of the trip is 64 days, which is greater than 60 days granted by a tourist visa, you cannot just say 'oh we will extend it' on the application form. It is a binary decision i.e. if your trip > 60 days it will be refused

They qualify for O visa being dependents on their Mum (Thai national), who is visiting family. Or that's what the Chicago Consulate-General has instructed.

If it is then get a double entry and do a border run.

Again over-thinking the issue .

If the Mrs cannot be bothered to secure extensions of stay then she can pay the overstay fines of 500 Bhat /day but only if the children are over the age of 14/15yrs

Give it up !

It has no effect and is in fact the responsibility of the Parent !

I suggest that you contact the Consulate and ask what they require to issue a Non Imm O Visa to visit family.

Why not try a different "consulate" you may get a "different" response !

All that should be needed is proof of Thai nationality to get single entry non-o visas. Just their birth certificates and your wife's passport should be enough to get them.

If your kids live overseas they aren't liable for conscription.
