Hello all,A good friend of mine needs the help of a falung that can speak Thai or a Thai that can speak reasonable english to help him in a family meeting

to resolve a problem whereby he could lose his house,the meeting will take place sometime next week.Now for some back ground.

My friend has been back in Australia for the past 12 months getting his affairs in order so he can return to the LOS as a retiree,he did come back about a 6 weeks

ago on a flying visit but more of that later.Him and his wife own a house in a gated estate out by the lake.2 months ago he got a txt message from his wife in the middle

of the night saying it was all over don't come back to Thailand as you would imagine he was quite distressed as they have been together several years.For the next 2 weeks

he was only getting cryptic messages from the wife and not the full story so was quite confused as to why his would happen(medical issues prevented him coming straight back).

When he finally got here he found out the wifes older sister had talked her into putting the house up as collateral and her own home for a business loan with a shark,The

sister is currently repaying the loan shark 58,000 baht a month on the house and has no idea what shes repaying on her own home as its valued at about 5.8 mil. His wife is telling him that the sisters business is not making any money so its only a matter of time before she will fail to make payment and my mate and his wife will lose there house.In regards to him returning on a quick visit,he found his wife in a state of being an emotional wreck with no family support and wont leave the house.As terry cannot speak Thai

it was very difficult for him to get any information on whether the loan was with a bank or a shark and only found out after he returned to Aus as the sister was being very cagey with him and his wife.So Terry will be returning next week to try and sort all this out so is there any one out there that would be willing to help or point him to an english speaking lawyer(Siam legal dont have an office in KK) they can PM me and i will give you his details.

I really feel sorry for your friend. I don't know a good lawyer there, but I know a very decent lawyer in Ubon Ratchathani, who's not a rip off guy.

Not one of these "pay me 20 K, before I do anything guys." Tell your friend to have all bank statements, everything that proofs that then money finally came from him.

When the house was purchased, he probably signed a form saying that the money was hers, and that she wasn't buying the house for him - which would be illegal.

Be aware that the interest rate (if from a 'loan shark') is likely to be 3% to 5% per month.

Also be aware that the legal maximum that can be charged is 18% per annum. The land office will be aware of that and confirmed the same recently to a friend when he had the same thing happen to him.

If it gets sorted out satisfactorily get a usufruct/superficiary or even a lease on the property - that will keep the chanote away from would-be lenders.

What often occurs is a separate contract is presented which the property in question is used as a guarantee that it will be repaid. These contracts are often done in the presence of several witnesses who also put their signature on the contract. Basically the end game is that the property has to be sold if the balance can't be repaid. Most loans I have seen average 10% per month. Although most I seen are smaller loans with a smaller guarantee like gold. However I have personally paid out a loan shark about 300k baht to ensure get to keep a farm ( with conditions attached). They initially borrowed 200k at 10% per month. My partner now has quite a lot of land in her name as a result
