Does the same thing apply in a hotel or condo? If the form is not done who pays the fine the owner or the renter?

For a hotel or a business doing the rentals it is different and the fines are higher.

If you were considered the possessor you could be fined for not reporting yourself but they don't normally do it.

That is the question I was asking. Who is the possessor; the renter or the owner? If I check into a guest house as a renter do I have to file a TM-30? Where is the definition of possessor?

A guest house would be a business. You would not be the possessor.

If you have rental or lease contract for your place of residence you could be considered the possessor because you are in possession of it.

Are you saying house you can possess but not an apartment? If you have a lease are you the possessor and required to file a TM-30? House, townhouse, condo, apartment, room in a house, guest house, hotel. Is possession determined by your contract or how long you have the contract or the type of housing? Where is the definition of possessor? Thai or English is OK.

The Immigration Act does not define "possessor" but mentions "possessor" as one of several examples of capacities in which a person can be the "Hous Master" of a residence.

Section 4 : In this Act :

...

“ House Master ” means any persons who is the chief possessor of a house , whether in the capacity of
owner , tenant , or in any other capacity whatsoever , in accordance with the law on people act.

...

It is the "House Master" who must submit the form TM.30 "NOTIFICATION FROM FOR HOUSE-MASTER, OWNER OR THE POSSESSOR OF THE RESIDENCE WHERE ALIEN HAS STAYED"

2. Question : What do the house-master/owner or possessor of the residence have to do,if the alien granted temporary stay in Thailand has stayed in his/her house/residence? (Is it possible for an agent to do for?)

Answer : He/She (The owner of the residence) must notify (by the Form TM.30) to the competent official Of the Immigration Office located in the same area of that house/residence within 24 hours from the time of arrival of the alien. However, such notification could be made in person or by an agent or sent with completed Form( TM.30) by registered post.

Wrong answer on that FAQ. Not necessarily the owner of the residence, but the House Master, who, depending on the situation, could be any of several persons, including, but not limited to, the owner, as defined in section 4 of the Immigration Act.

An immigration office's FAQ does not overrule the law, does it?
