CDC: red-carding authority going to court because of neutrality, witness protection

BANGKOK, 20 July 2015 (NNT) – The Constitution Drafting Committee (CDC) has indicated that the decision to transfer the authority to red-card election candidates to the court is due to the latter's independence, neutrality and speed as well as the ability to protect the identity of witnesses.

According to Khamnoon Sitthisamarn, spokesperson of the CDC, red-carding results in a severe penalty and has life-long effect on election candidates, and thus the red-carding power should be handed to the Court of Justice as it had independence, neutrality, ability to work speedily and the ability to discreetly process cases for the sake of witness protection.

General Lertrat Rattanawanich, another CDC spokesman, disclosed that most members of the CDC also voted in favor of amending the stipulations found in the B.E. 2540 and 2550 constitutions related to the right and duty of citizens in casting votes. The aim of the amendment is to promote people's participation in governance. Under the proposed amendment, those who will not be casting their ballots at elections and referendums must inform the Election Commission in advance of their reason in order to avoid losing their political rights.

NLA subcommittee suggests delaying petroleum grants until relevant laws are updated

BANGKOK, 20 July 2015 (NNT) – Dr. Poldej Pinpratheep, deputy chairman of the National Legislative Assembly's (NLA) input-seeking subcommittee, has expressed the view that the upcoming round of petroleum concession granting should be delayed until relevant laws have been updated.

Speaking at a seminar on the draft petroleum bill and relevant laws, Dr. Poldej said that the draft laws did not cover all aspects relevant to petroleum concession, and that it would be of benefit to gather public opinion before the draft bill is forwarded to the NLA for processing. He said doing so would ensure the highest gains for the public and the government and also ensure the legitimacy of the bill.

The NLA's study panel on law enforcement problems, after studying the problems associated with the enforcement of the B.E. 2514 Petroleum Act and the B.E. 2514 law on monetary gains from petroleum, expressed its view that the laws should be improved before the new round of petroleum concession granting takes place. It also suggested that information relevant to petroleum affairs be divulged to the public.
