Work Permit Application is taking too long

Featured Replies

Hoping that I could get some answers and information in this forum.

I am having my doubts on the people that is doing the application of my work-permit.

I have been successfully granted the Non-B visa, which is required to apply for the work permit.

So as normal as it should be, The WP application should not take more than 2 weeks to process.

However, for-who-the-hell knows, after more than 2 months, I still have no WP.

My Non-B Visa validity is only until the 16th of October. Hence I've been checking up for the updates for the HR Officer.

First, she told me that just wait for a few weeks. - to make the long story short, its crap, here I am still waiting.

Also, I think that I also have a workmate having the same issue, but I am not sure of his details because he is in the other department.

Just today, I just checked again for any update, and she told me that;

*The first application has been denied because the documents are not enough.

*She is just waiting now for the document and will apply for the WP application. (She is hight confident that this time, it will be approved)

So, my concern is that;

IF, ever that, the new new documents are alright and the application has been approved. How long does the application for WP to be processed?

What would be my situation if the application for my WP has been approved but I have, lets say 3-4 days left valid for my Non-B Visa?

Because on what I heard, It will take at least 7 days to complete the application for WP.

What would be the case if my Non-B Visa expires while my application for WP is still on process?

Your inputs are much appreciated.

Who is telling you it only takes two weeks ? My very first WP some 14 years ago took nearly 3 months to receive....after that renewal in 7 to 10 days became the norm....while the WP is in process immigration will put an under consideration stamp in your pp assuming of course the company has applied...once you have the "under consideration" stamp in your pp it doesnt matter if you B visa expires.....

Surely that would on the OP applying for an extension of stay with a full set of documentation provided by his employer ?

Yes, with full documentation. It should take not more than 2 weeks.

I know a few people had done so.

Unfortunately, the HR liason officer is the one doing all the works, checking the documents, and applying the work permit ,etc etc.

The validity date of my WP would have the same validity date of my Non-B Visa. Is that right? and if my Non-B Visa expires while processing the WP. Then I need to have it extended or I'd be over staying. If not, the WP will also be invalid?

No the b visa and WP are not tied together as regards dates, as stated if your WP is still in process immigration can put an "under consideration" in your PP thus extending your permission to stay date in your PP beyond the date of your b visa

So, if my wp is still under process, immigration will put it in under consideration regarding the validity of my stay beyond the date of my non-b visa.

So, after the work permit is processed while my validity to stay in Thailand is under consideration, what would happen next? Would my existing non-b visa with consideration be able to extend for 1 year?

Yes...will/can...

i assume you have a single entry B visa so the next step after getting your WP would be being issued a 1 year extension of stay on the basis of employment which is not an extension of a B visa...its not a visa, you would no longer have a visa

So, after I get my work permit. I will be eligible to have the extension of my stay to 1 year? regardless of the non-b visa status?

Yes if you qualify for the extension of stay having the WP is only part of it, you also need to earn enough money ( except on case of teachers)

Alright, I'll let our HR Liason know the details.

Thanks

Your HR if they are competant should know these details already

I have had 5 work permits, in Korat, Kalasin, Sahatsakhan and Roi-Et. 7 days no longer each time with the proper paperwork.

I got my work permit pretty quick but my 1 year extension of stay took almost 4 months and because my lawyer applied for it 30 days prior to a scheduled trip out of the country I had to change my flight from the US to return early just to get back to Immigration by my "appear at Immigration" date only to be told to wait for another month by Immigration. Apparently not only does my GF think I have a bottomless wallet, so does my lawyer and Immigration. Bottom line OP, if you have the 30 day consideration stamp in your passport you are good to relax even if your current entry (leave by date) expires. But you gotta get to that point before you can remotely relax. You do have to stay right on top of the people helping you but you gotta sugar coat everything of they get all butt hurt and then you get nothing. Bring HR some fresh fruit everytime you "stop in to say hello".

Just one of the many pleasures of doing business in Thailand.

Personally, I would set a date with the HR person for you both to go and get it done.

Trusting a person to do things is not in your best interest.

I worked with a US guy for almost a year who had regular applications refused. Eventually it was approved, a few weeks before his contract ended. Keep trying.
