Hi, we're filling out the forms, seems better than expected thus far, with the help of reading old topics on here of course.
My wife will have been in the UK for 30 months on the 21st of December, therefore i believe we can apply from the 23rd of November. I started a new job on the 26th of May. I need to have been with my current employer for a minimum of 6 months before submitting the application. We have booked our holidays from 9th December to 31st. Her current entry clearance visa runs out on the 16th of February.

The query is how long does the BRP card take to come. My wife wants to do the premium service as she wants to know immediately. Preferably we'd like to get the decision before our hols. I would get a letter from my employer stating length of employment and salary after the 26th of November. Which leaves us with 28th amd 30th November, 1st-5th,7th and 8th of December to book the premium service.
On the BRP guidance notes it says, "We advise you not to book any non-urgent travel before you have received your permit."

I know the basic thing would be to go in January after our hols, but it would be nicer to relax on holiday and not fret over the application.

Another thing is, I didn't get a payslip for June from my current employer. Will 5 payslips be sufficient? I do have statements showing moneys in. Also have payslips from previous employer. Do you just put all documents in or do they need indexing? Plus what's everyone's opinions on getting bank statements and payslips notarised?

English language requirement If you are aged 64 or under, you must provide one of the following;

  1. If you sat your English language test before 6th April 2015, an original certificate and/or other specified evidence showing that you have passed an acceptable English Language test provided by a test provider approved by the Home Office for this purpose;
  2. If you are not including this because you provided it with your previous successful application for leave with your partner in this category, or leave as a parent please tick this box;
  3. or If you sat your Home Office approved test on or after 6th April 2015 you do not have to send your certificate, but should ensure that you state the test number at section 8.4 of the form; or
  4. An original certificate showing that you have been awarded an appropriate acceptable academic qualification, showing your name, the title of the award, the date of the award and the name of the awarding institution; or
  5. An academic transcript and an academic reference from the institution that awarded your academic qualification (See section 21e) of FLR(M) guidance notes for further information)
  6. A passport or travel document showing that you are a national of a majority English speaking country. See note 7.

    Note 7 If you are unable to provide your passport or travel document, you may only submit other evidence of your nationality in certain circumstances. These circumstances are; • Where your passport has been lost or stolen • Where your passport has expired and been returned to the relevant authorities, or • Where the passport is with another part of the Home Office.



    My wife's test was used in her entry clearance visa and is no longer acceptable. Therefore, we are ok as her test was accepted for a previous application.
    Do we tick option 2 and don't include any certificate in the supporting documents?

I did my wife's FLR recently without using the premium service. I was pleasantly surprised how quick the turn around was. She got her passport back with FLR confirmation letter in 3 weeks and just a few days later she got her BRP.

As for the English test we were in a similar situation. I ticked box 2 but I also included the original BULATS test cert + a photocopy. I also included an explanatory note quoting UKVI guidelines on this complicated subject. She got the FLR and they retained the photocopy of her cert.

Btw, what test did your wife do in Thailand? May be a problem if it was TOEIC because they were struck off for fraud. BULATS and Pearsons is ok.

naruk, that was a difficult and tangled read, but, there you go. You obviously have a sense of adventure and liking for living dangerously. Blimey.

Okay, you've provided an array of dates that you can manage to attend the PEO, but, please bear in mind that securing a date at the PEO is a hit and miss affair. I was up at 5am in the morning to secure my wife an appointment and that was two months prior to the date of the required appointment. Got there in the end but took a few early mornings to get what I wanted. So, beware.

You should ordinarily receive the BRP card within a few days of a successful PEO visit. My wife's appointment was on a Monday and the BRP was received by courier on the Wednesday. Not bad, but might not necessarily be the case in all instances.

Another thing is, I didn't get a payslip for June from my current employer. Will 5 payslips be sufficient?

Why not? This is where you are living dangerously, so you'll either have to retrieve the missing payslip from your employer or refer to the omission in the application. Can you request a letter from your employer confirming a satisfactory reason as to why you are not in possession of the payslip and that your employer details within that letter a digest of you gross and net pay, including deductions?

Do you just put all documents in or do they need indexing?

What would you like to see if you were an ECO? Personally, I'd like to see some order. Up to you. Though, I can confirm that my indexed file for my wife's ILR application at Croydon PEO was returned within twenty minutes with a nice letter confirming a successful application.

Here's what I would do, try and secure an appointment at your local PEO for well before your holiday, or just after and ensure to address the missing payslip.

As for your English language question, I'll leave that to others to respond as I'm uncertain of the latest requirements.

Naruk86 you have made the same mistake that I made and counted 30 months from the date of entry. You need to count 28 days backwards from what ever visa expiry date is on the visa.

I thought my wife's visa expired on the 8 September when in fact it was the 18 November. So she couldn't apply before the 15 October.

Got the missing payslip so no problem there. I saw elsewhere on here that it was 30 months from date of entry. Thanks for all the help.

Wooloomooloo, my English isn't the best, sorry for being hard to understand. I was just trying to give as much info as possible.
