Administrative Court rejects CAT unionists' lawsuit against NBTC

BANGKOK: -- The Central Administrative Court Wednesday rejected a lawsuit filed by unionists of the CAT Telecom Plc against the National Broadcasting and Telecommunication Commission seeking to annul the bidding of 1,800 MHz bandwidth for 4G data services.

The lawsuit was filed on November 10 a day before the bidding was held. The unionists asked the court to issue an injunction to suspend the bidding pending the court's ruling.

But the court refused to issue an injunction and it decided Wednesday to reject the lawsuit on ground that the unionists were not the affected party. The court said had the bidding affected the rights of the CAT Telecom, the firm should have been the one to file the lawsuit.

There are still govt bodies thinking that they have the right to control public assets.

I recall two decades ago, it takes tens of thousands and a waiting time of a year just to get a telephone land line. Are they hoping a return of the good old days?

CAT Telecom is a state-owned enterprise. It has no private equity shareholders. NBTC is a state agency. Therefore, there cannot be any adverse relationship between the two that would allow for a lawsuit.

The unionist members as consumers would be affected parties that should have grounds to sue NBTC, ie., in a class action lawsuit. Perhaps if the lawsuit is refilled with that approach, the court might accept it.
