CDC Chairman: No need for impeachment law against corrupt politicians

BANGKOK, 22 November 2015 (NNT) - The Chairman of the Constitution Drafting Commission believes there is no need for a specific impeachment law to deal with corrupt politicians.

CDC Chairman Meechai Richupan said that, when it comes to any future impeachment of a politician on behalf of the Senate, the decision should first determine whether or not a politician or an official is accused of malfeasance in their duties.

If such an accusation has grounds, Mr. Meechai agreed that the case must be put into the hands of the National Anti-Corruption Commission to investigate, while the result should be the removal of the accused if he or she is found guilty.

He added that where any case related to the lack of qualifications or ethics of a politician has been considered by the Constitutional Court, the CDC has already added details to the court’s authority to enable the judges to try, and then remove any guilty defendants. Therefore no new law is needed to enable the Constitutional Court to effectively perform an impeachment.

Finally someone who makes sense. The laws exist and its about time they were enforced across the board. No exceptions.

Law enforcement in Thailand is as elusive as finding a Thai "English" teacher who can have a conversation in the language they " teach.

Laws here seem to be just a general thought of how things could be, or how some other societies encourage a civility. But to Thai

" free men", no rule/law applies. And I bet never will.

The old saying is ' where there's a will there's a way ' but in LoS there's no will and no way unless you are a nobody or someone the govt of the day has targeted.

Otherwise it's PWD - Plunder Without Danger, at least until you fall out of favour and / or a new govt takes over and you lose your status as one of the Chosen People.

Plunder Without Danger is EXACTLY what Thailand's elite/powerful do and do and do. I think that's the only reason for this country's existence. "Little people" are used for labor/sex/ servitude and all the gains go to "the big people."

You describe Lack of Sanctions/Land of Scams PERFECTLY.

I wonder if this red herring is to prevent people from speculating that the 300k conscription of Thais into the military and the idea that was vetted about using conscripts as police officers are related issues... A military police force would make a coup unnecessary.

He does make a lot of sense. An unenforced law is as bad as a bad law. Bad laws need to be repealed. (The remaining good) laws need to be enforced.

Using traffic laws as a template, laws in Thailand are there to be obeyed by people other than me because (1) I am always important ergo my needs always trump everyone else's (2) I am always in a justifiable hurry and (3) because my car/ute is the one with the TRD or Race Modification Company stickers on it.

(4) would be.... It makes an important part of my anatomy bigger& stronger to attract herds of panting potential mia nois. (Power is the ultimate aphrodisiac)

I think there is a lot that needs to be clarified concerning impeachment and criminal prosecution of politicians in Thailand.

For example:

1) Why does Thailand use a unique definition of impeachment, and why do people continue to regard impeachment and criminal prosecution as the same thing? (they are not)

2) Why is impeachment conducted in Thailand after a person leaves office? (probably because of item 1)

3) What is the mechanism for punishment of NLA members when offenses fall short of outright criminal acts? Shouldn't censure and impeachment be two things the NLA should be empowered to do, as a means of handling non-criminal, yet egregious behaviors (for example, violating parliamentary procedures).

4) Why has the NACC morphed from a strategic policy Commission to an investigative and prosecutorial body? Doesn't this weaken the normal institutions for prosecution?

5) Why are political corruption cases taken directly by NACC to a Supreme Court division, where defendants have no right of appeal? Doesn't this undercut a bedrock principle of justice? (the Supreme Court should be performing strong oversight of trials and opinions by lower courts by hearing appeals, not holding trials themselves).
