Dear Ubonjoe,

Are there any consequences I might face for overstaying for 12 days besides paying the fine at the the airport...i.e. future Visa applications

Why would you have the overstay? There should be a way to avoid it.

A 12 day overstay would have no effect on applying for a visa at an embassy or consulate.

Depending on the Embassy or Consulate where you apply for a Visa they may refuse to issue you a Visa because of the overstay stamp seen in your passport.

Some Embassies or Consulates will ignore it while some will use it as the reason to refuse you a visa.

If you try to enter through an airport in Thailand you will learn soon enough if they will ignore that overstay stamp in your passport...or not

if you enter by land at any border crossing you will learn soon enough if they ignore the overstay stamp ..or not.

That is the problem with having the overstay stamp in your passport while that overstay stamp in your passport can and sometimes will be used as the reason to they refuse to issue a visa or refuse your entry into the Thailand.

Usually it is not a big deal...but they are cracking down on that particular issue of overstay while we read about the new penalties and ramifications of overstaying your visa or extension ...while they are talking about applying reprimands.

How harshly the new rules and regulations are enforced is yet to be seen and how long it takes to turn lax again and or corrupted??? ...is hard to say...but usually such affairs are not enforced harshly.

A lot of people have had overstays longer than 12 days and come straight back in, no issues.

Why not do a quick border crossing before your visa expires or even get an Extension at immigration, save the hassle

This is scaremongering, and simply not true.

Especially not for short term overstay.

Especially not for short term overstay.

Not scare mongering at all.

Even back in 1991 after having overstay stamps in my passport the consulate general in Hong Kong turned down my application for a 90 day tourist visa.

The consulate general interviewed me himself when I went to pick up my passport and told me he decided to refuse my application because I had overstayed and stated:

"I do not like to see overstay stamps in peoples passports as that is a violation of our immigration laws and that is why I am refusing to grant you a 90 day visa ...but I have given you a 30 day tourist visa.

The man also told me he would not accept my passport at his embassy for the next 2 years.

When I asked him about other Thai Embassies or Consulates he told me : "Up to them ....they can do what they want .....but here at this Embassy, I will reject the application when I see overstays in a persons passport.

Next time I simply went to Penang Malaysia , again, where everyone was always granted a visa.

You can believe it or not ..I do not care...but I am telling you when they see that overstay stamp in your passport they can and will if they want reject your application for that very reason and that reason only.......if they want.

A cleared overstay should be a past. The immigration officers will question you. That's for sure! But make sure you have a few things with you that you can prove to them you are here for holiday. 10,000(for 30days visa exempt) 20,000(for single entry 60days visa). Bookings of hotel. (You won't get away telling them you'll find one later) *Best assurance to them is a return ticket to you own country. Not to any nearby country. Lastly for long time overstayer I suggest to bring along your bank statement for the last 6month. (To prove that you are not working during your overstay) All of this I have it with me all the time but never been asked before. But better to be safe than to be sorry.

Oh one last thing. Apply you visa in Laos / Penang. Singapore/Hong Kong/ KL they will find excuse to reject you if they can. They dont want to be responsible for you overstaying again. From another post someone posted that the Hong Kong embassy even asked for the bank statement for the whole period that he overstayed. I just called up my bank for bank statement over 6month is not free. They will charge you for every month statement that you need. My case I roughly counted if I need it it'll cost me about 25000THB to get the bank statement for the past 3years. So that is simpily an excuse for them to reject you.

Appologies for the late reply all.

I was really stressed on this issue before (multi level screw up that caused the overstay, involving my company, immigration ..etc..)

Any way, I went to immigration at dong mueng - told them I overstayed, scary women behind the counter asked how long, I just crapped out 10 days, she snapped back that its 11....whatever.

I go to the tiny room behind, repeated- immi guy said no-problem only 11 days but pointed at some warning sign of the new rules. Immi lady asked if I have money , and paid, receipt with a tiny stamp in my passport that includes the amount.

I go to KL the following day to apply for Non-B. Some young punk at the counter was pointing at the stamp and snickering, anyhow no issues, collected my Non-B the following day.

At the KL embassy, they were giving an elderly western couple a hard time when I think they were applying for a tourist visa, asking them for some employment letter and such.

No issues entering at Don Mueng.

Please note all this occurred before the new overstay rules.
