Hi,

I got a workpermit in April, which - as far as I understand - in principle is good for one year... Meaning that: Assumed immigration allows me to stay in Thailand the year through and assumed I keep my job, I wouldn't have to visit labor department again until that year was gone.

However, although labor department has "sort of" granted the WP for a year, it is only valid until the date defined in the "permitted-to-stay-until-stamp" given by immigration. My second one-year spouse supporting stay-allowance extension is due this week. Not concerned about that part, but after I've gotten the "under consideration" stamp, I'll have to go to labor department to get the WP updated with a related date-stamp.

My question is: what exactly do I need to bring to labor department (besides myself, my passport and my WP)?

when I had to get mine done whilst "under consoderation" it was a case of handing in the usual documents and paying a smaller fee as the extension was only for the 30 days

Extension of Stay Based on Business

Documents Required

1. Application form (T.M. 7 )

2. Passport or document used in lien of passport and its copies.

3. The applicant’s 4 x 6 cm. photograph.

4. Extension fee Baht 1,900.-

5. The company’s letter certifying as follows;

- Nature of business

- Reason or necessity in employing the applicant his / her position, salary and education background.

- Number of Thai and foreign employees.

6. Copies of work permit or receipt of work permit application.

7. Company’s annual balance sheets.

8. The juristic person’s Annual Income Tax Declaration Form (Form No.50) of the latest year and its receipt of payment.

9. Thai employees Monthly Income Tax Declaration Form (Form No.1 ) of the latest month and its receipt of payment.

10. The applicant’s Annual Income Tax Declaration Form (Form No.91) of the latest year and its receipt of payment.

11. The official letter that certify the registration of such juristic person.

12. Business Registration or Business License.

13. Value Added Tax Registration and list of share holders.

14. A map that indicates the location of the Company.

15. For those who operate export business, the documentary evidence clarifying its export activities is needed.

16. For those who operate tourism business, the documentary evidence clarifying 1,200 tourist were brought in by the company, is needed.

This is if it is a renewal of an extension of stay based on business prior to Oct 1st, 2006.

If it is a new extension of stay based on business, after Oct 1st 2006. You need these doc's:

Criteria

(1) The foreigner must obtain permit stamp for the temporary entry and

(2) The foreigner must earn salary at the rate in accordance to the rate attached to this order and

(3) The business must have a registered capital of no less than 2 Million Baht and

(4) That business must submit their year end balance sheet which has been inspect and certified by a certified accountant. In order to show the financial status, stability and recognition of business. In overall the audit must show owner’s equity of no less than 1 Million Baht and

(5) That business must submit their year end profit and loss account which has been inspect and certified by a certified accountant. In overall the total revenue must show an amount higher than the total salary and benefit paid the employee and

(6) That certain business has the necessity to employ foreigner and

(7) The foreign must obtain permit stamp for the temporary entry and

(8) That business must have a ratio between foreign employee to Thai employee of 1:4 and

(8) The following business shall be exempted from the obligation stated in Point (3), (4), (5) and (6) and will be indulgent in the number of Thai as stated in Point (7), where they can use 1 Foreigner to 1 full-time Thai staff

(a) International Trade business (Representative Office)

b Regional Office

c International companies (Branch office)

List of required documents

1. Petition Forms

2. Copy of Passport of the Applicant

3. Acceptance Letter for the intake of a foreigner into workplace (must follow the format of the Immigration Bureau).

4. Copy of Working permit

5. Copies of Company registration documents i.e. Company’s Affidavit and etc. Such document shall not be issued for no longer than 6 months.

6. Copies of the current shareholders list (issued by the registrar for no longer than 6 months).

7. Copies of the latest annual audit

8. Copies of the company’s latest withholding tax illustrating the list of all employees and the names of all foreigners

9. Copies of the foreigner’s income tax submitted annually attaching a receipt (if any)

10. Copies of the latest payment on social funds submitted to the Social Security Office (Sor Por Sor 1-10)

11. Documents or relevant supporting documents illustrating the importance of the foreigner to the company i.e. Job Advertisement looking for Thai applicants but no Thai interested etc.

12. Map showing the office and workplace of the applicant.

13. Other documents which the Investigation Committee may require.

14. Businesses established in accordance to Point (8) do not have to show documents listed in 6,7, and 11

Again, this is the required documents and criteria if you are applying for the extension of stay based on business after Oct. 1st 2006, for the first time.

Questions for Sunbelt:

I will apply for extension of non b and work permit for the first time next month. I believe my company was formed May this year and I guess there is no annual audit yet. Does this mean I will be denied extension? Should I plan a trip to Malaysia to get another non b -- say 90 days -- and apply for extension early next year after the audit papers are out? What happens to my work permit if I am denied extension?

Yes

What happens to my work permit if I am denied extension?

It expires so it is why you need to go outside the country and get a new non immigrant visa.

Have been to labor department and is now in position to answer my own question:

Required documentation for a workpermit extension:

1) One copy of passport's datapage

2) one copy of passport page with latest stamp.

You'll have to fill out form WP 5 - labels are in both Thai and English ...Basically, you just copy data from your passport and workpermit to the form - easy). You pay a governmental fee of 850 Baht. The procedure takes a bout 5 minutes, no questions to be answered.

What you get is a new stamp in your workpermit stating it is valid until the same date as your staypermit.

Sunbelt: How does one proceed with coordination of WP and Permission to stay extension?

Suppose you have a B Visa with stay until December 1, and a WP with the same expiry. Guess you leave the Country on Dec 1, get a new B Visa, return, and extend your WP first thing next morning before showing up at work.

But what in case you have an O Visa for wife? Lets again say until Dec. 1st.

Go to Immigration with Job Papers and all, get a temorary under consideration, get the WP extended for the 30 days, and repeat ad nauseam? Makes me wonder how you are supposed to actually work then?

Also, is there a chance somewhere in the region to get a 1Y Multi B in the case you have a workpermit (but your company can't show the profits etc. necessary for a 1Y extension as it is a startup)?

You do not need to leave the country if you have a extension of stay. You simply do a renewal or extension. Your work permit then corresponds to that extension.

The visa "under consideration" for 30 days will always drive you nuts as you need to extend the work permit for an additional 30 days as well. Every 30 days brings the same till they give you the year.

KL if you have three months of a PND 1 with a work permit.
