Ja New lodges complaint to police demanding legal action against his captors

BANGKOK: -- Thammasat student activist Sirawich Seritiwat or Ja New filed a complaint with Klong Luang district police today (Monday) demanding the police to take legal action a group of unknown military personnel for illegally detaining him and depriving him of freedom.

Ja New also handed over to the police a copy of the video footage purportedly showing him being taken and forced into a car by hooded men believed to be military personnel. The incident took place in front of Thammasat University’s Rangsit campus on the night of January 20.

Ja New told the police that, at least, his captors should have shown him the arrest warrant and should have immediately taken him to the police station. However, he said he would driven around in the car for several hours before being taken to the police station.

He suggested that his arrest by the military men amounted to illegal detention. He also insisted that during his brief detention he was struck in his head and back three times.

Pol Col Manas Nakhonsri, the enquiry officer, said that military officers from the Second Battalion of the Second Regiment of the Royal Guards had already approached him and claimed that Ja Jew’s captors acted on order issued under Section 44 of the interim constitution.

I was thinking the same thing. So if he (uncle too) did give the order, and the military court let him go so then what? was it just a message to Ja and others? we can take you anytime anywhere?

So many criticised Art 44 for giving one man absolute power and the potential for serious abuse and misuse despite assurances the PM would use it only when absolutely warranted.

If he's the only one who can use Art 44 where did the military personnel get the authority to detain from ?

Either the PM ordered it, directly or indirectly, or those involved took it upon themselves to act and are now claiming it was lawful under 44.

This article allows some serious power to be used and can't be allowed to be some cover all excuse.

The PM is either complicit in what happened or negligent in not ensuring it was made perfectly clear the authority is his alone.

I'd suggest this situation is a hard one for the PM etc to explain but I doubt they'll even bother.

why would he lie given the repercussions that the Thai military is known for including prisoners dying / committing suicide in their detention centers?

of course it is, really, politically motivated - motivated for the military to get out of politics and return sovereignty to the Thai people - but I think you got that one right by accident.

Naturally you would not think it brave to stand up to an oppressive force as he has, because if you did acknowledge his bravery, then it would force you to examine your own lack thereof...
