visa overstay question

Featured Replies

I have a non B multiple entry.

Now, my latest stamp expires on Feb 21st, and i am flying out on 23rd.

Will this be a problem, like void my visa or something like that.

I am aware i will get a 500 baht fine.

Would i be better of getting another 3 months.

Thanks

It would not void your visa.

The fine will be 1000 baht for 2 days of overstay.

You could apply for a 7 day extension, pay the 1900 fee and be given 7 days to leave the country.

The only risk is being caught with the overstay before you get to the airport.

You could go to the airport on the 22nd and get stamped out then and you wont get fined

Expires midnight 21 February

The new rules don't start until March 20th.

Even if they were in effect he would not be banned because his overstay is not over 90 days unless he was caught before he got to the airport but is not known how they would handle a one or 2 day overstay under the rules.

You are allowed a one day over stay at airports

You've three choices.

  1. If your visa hasn't yet expired you could do a border hop and get another 90 day stay which would keep you legal until you leave.
  2. Go to immigration and ask for an extension of stay which will be denied, pay 1,900 baht, and be given 7 days to leave the country.
  3. Risk getting caught on overstay and possibly sent through the deportation process, and pay 1,000 baht if you make it to the airport.

Actually it is an overstay of less than 24 hours that they waive the fine for at the airports in Bangkok. More than 24 hours and you pay the fine for those 24 hours when you leave.

Isnt 24 hours, the same as one day ?

Just quoting what the stamp says on it that immigration does for them. I also suspect that is how it is written in the rules about it. The point was though that the fine for the first day or 24 hours is not waived if the overstay is longer than that.

New rules in march

Overstayed 1 day. Should have left on 29th according to stamp. Left 30th (stamped out) with no fine nor red stamp. Officer wrote by hand that 1 overstayed one day next to departure stamp. My actual departure flight from Thai soil was on 31st (4 hours after being stamped out). Cheers.

Thanks guys. I will take my chances.

As long as my visa isn't voided, and i get my 3 months when i get back, which is my main concern.

One day really isn't a problem. Be polite, tell the officer yourself you overstayed 1 day like i did. Note that the guy at the cue didn't stamp me though. I had to go to nearby desk where another friendly officer stamped me out and even asked when i was coming back thumbsup.gif

In my case the reason for overstay was easy: upon booking my ticket (months ago) it seemed that i could save 80€ (cheaper return flight) by staying 61 days in stead of 60.
