BANGKOK: -- About 30 residents of a village in Pak Chong district of Nakhon Ratchasima lodged a petition to the Justice Ministry on Monday seeking a reprieve from the blockade of their only route to their village through a farm.


Mr Samarn Khienkhokkuad, the leader of the villagers, said that they had been using the route to get to Ban Hin Ploeng village in Tambon Khanong Phra since their forefathers until about 4-5 months ago when the owner of the farm blocked the route and put up a sign allowing the villagers to use the route during 7 am-1 pm.

Samarn said the villagers didn’t understand why the farm blocked the route and doubted the farm had the right to do just that. Complaints were lodged with the Khanong Phra tambon administration organization and the Damrongtham centre in Nakhon Ratchasima but the blockade remains intact.

“There are about 20 households in the village and we are suffering because we cannot leave or get into our village after the permissable hours,” said Mr Samarn.

Justice deputy permanent secretary Pol Col Dusadee Arayawuth said that the ministry would dispatch a fact-finding team to the site to find out what has actually happened.

He indicated that the problem might stem from land overlapping which, he said, is quite common resulting to many complaints being lodged with the Justice Ministry.

So these people are not.actually blocked from going out. They just need to take route 7. Translation error or just making it sound worse than it actually is. Seems to me if they were passing through this guy's farm that he has a right to block the pass during odd hours.

No'p your wrong, The owner can not block the way but he can ask for compensation from the users, it's the if you owned a block of land behind another block, you can not be blocked out but you can be charged a compensation,,,,,

Pol Col Dusadee, who is also Justice dep perm sec, (is he getting two salaries?) in true police form has managed to find the fact before dispatching the fact-finders. The land is overlapping itself, must have happened during the last earthquake...whenever that was, maybe Jurassic?

If the path has been used for generations without attempt by landowner to block it's use, in many places easement rights would apply to give villagers continued access and use. But hey, this is Thailand.....

The owner does recognize the right of public access through his property.

At best (assuming land laws are followed and not circumvented by the junta or secret deals) the owner will be able to restrict allow passage from 7am-7pm unless the community can show a reason for nightly passage. Otherwise unchallenged public access for more than 10 years has established throughfare.

Just another example of why true reform in Thailand would include decentralization of police and courts. Local authorities could resolve local disputes and justice would be more likely.

Or not... I mean corruption is everywhere money talks.. seriously I am all for decentralization but I think its foolish to think that it would do much good.
