refund / cancel policy from in pattaya.

why would anyone order something and expect to be entitled to cancel ?

Maybe because it's consumer law?

If I buy anything, except food items, at Big C , Tesco or home pro I have the right to return it within 7 days to get a full refund. I don't even have to give a reason, but the item has to be in the same condition as when I bought it.

Home pro even has this extended to 14 days.

I didn't know that there is a legal return policy of 7 days - could you please link to the law ?

of course if this is an official Law, then OP has every right to have the Law applied.

NOTE TO ALL - i got a refund tonight, i had to pay a money under the counter, so it can be done. if buying - do not pay 100% upfront. pay minimum deposit only.

i broke a golden rule to my cost - never again, will learn one day !!

I also asked my friend, who by coincidence happen to be the lawyer of OCPB in Pattaya, and he confirmed this, but that doesn't mean that every business in Thailand follows the law.

Did you know there is even a helmet law, and a drunk driving law, in Thailand?

Here's the problem. There are a lot of laws in Thailand, covering all types of problems/situations BUT, to have the law applied, one must go through legal channels and pay for a lawyer. That costs big bucks, even in Thailand. That's the reason why Thais do what they want because only big companies with resources will fork out for legal fees. For example, who's going to take a huge company to court over a small purchase. Even if someone did press the point legally, as soon as they get their first letter of demand, they'll probably pay up - in the meanwhile you've blown a lot of money on lawyer's fees.

It's all about bluff...

You can't win - you have to pay bribes or just try to appeal to their better nature - and hope for good luck.

I still want to see evidence of this, because in the two versions of consumer protection act I found, there are no provisions for returns/refunds.

That might have been so in the past, but things have changed in the last few years, since OCPB was formed.

They have cleared several cases for me, with local as well as multinational companies, and each time it took them a single phone call.

Some large companies were ignoring my claims for months in line. One phone call from OCPB and within 24 hours I received a refund.'

These days whenever I have an argument with a company it's enough to mention the magic 4 letter word, to have the argument solved there and then

You may have read another thread where I received just the other day a full refund from Samsung for a refrigerator I had bought in January 2015.

Happens to be that I bought the fridge from the same shop as the OP, and that they had already changed it twice in the first 2 months for the same problem.

After Samsung refunded me I bought a fridge from Hitachi which was heavily discounted, but which happens to make an awful fan noise 24 hours a day. I informed Hitachi head office and they told me this was normal and that they could do nothing about.

After the 5th phone call I told them that I had enough and that I would file a claim with OCPB right now, after which I hang up the phone.

Before I had reached the entrance of the highway to Pattaya I received a phone call from Hitachi that they would fully refund me, including the delivery cost.

But I agree that it still happens with Thai people, who in general shake on their feet when they see a person in uniform. A company like the one from the OP writes on their receipts " No refund" because they know they can impress Thai people with it.

It doesn't work with TheCruncher.

One example. My ex a few weeks ago bought a Imobile phone for the son. The phone would from the first day hold battery for about 6 hours on standby before it was completely discharged.

I told her to get back to shop and claim warranty. She produced all kind of excuses, from not having time to go back to have lost the receipt, until I told her, fine tell me the name of the shop and I will take back the phone. Then it changed to, you only can claim warranty on expensive phones. In other words, she was too scared to confront the shop with the faulty phone.

By the way, the inolvement of OCPB is free, and they will carry the cost of the lawyer if a court case is needed to protect your consumer rights.
