An unusual dilemma.

A friend has entered the country to live permanently. He entered on 'non-O' retirement, about five weeks ago. His 'non-O' was issued in Cardiff, in late August.

He exceeds all the financial requirements for extending the visa, PLUS has a Thai wife.

The dilemma: :ermm:

His 'non-O' doesn't expire until August 2007.

He now has a about 7 weeks to go before he must leave the country (visa run) and return again.

His health is not A1. He has painful hip problems and will soon be seeking replacement surgery here.

Question:

Is it necessary to leave the country, (visa run) or can he go to his local 'friendly' Immigration Office in Hua Hin, and have his 'permitted to stay' extended for another three months?

And can this be repeated until the visa is almost expired? Then follow the same procedure as me, and countless other members of T V and extend his visa (and rthus his stay) for 12 months?

He really does not want to do visa runs until the expiry of his visa, but seems to be resigning himself to the discomfort of this uneccesary trip in order to continue his otherwise happy retirement here in L o S.

If he has a retirement visa, O-A non immigrant, there is no need to leave after 90 days so you need to be sure what he has.

If he entered on a multi entry non immigrant O visa and his permitted to stay stamp was for 90 days he can change to a retirement extension of stay at any time with the income/bank deposit required for extensions of stay and then there would be no need to travel.

He can not have immigration "stamp him" if on a multi entry visa stay - he would have to leave country, enter another country and then return.

Is he perhaps here on a one year permitted to stay but has confused the 90 day address report requirement?

If permitted to stay stamp is only until December he should extend his stay at immigration.

If permitted to stay stamp is until August 2007 he only has to report his address and someone can do for him or it can be done by mail.

He did not enter on a non-imm O-A, but did enter on a multi entry non immgrant 'O' retirement visa. His permitted to stay stamp was for 90 days. This was the source of worry.

No. He is quite clear about this: I have drummed it into him many times.

If permitted to stay stamp is only until December he should extend his stay at immigration.

This is the case, and this is what I will advise him to do, until, that is, he subscribes to Thai Visa and then he can access your wisdom himself, in future!
