Guidance regarding cancelled WP, but valid extension of stay [changing jobs]

Featured Replies

Hi All,

Unfortunately I have a bit of a sticky situation w.r.t to WP & an extension of stay.

I parted ways with a company in Nov 2015 on bad terms, cancelled/returned my WP to Labor at the One-Stop service center.

However, I exited the country right after, without cancelling the associated extension of stay.

Although, I had tried to work things out with the company to cancel the above, nothing happened, so I left it at that.

Since then, I have traveled back a few times on this existing EOS for personal business e.g. clear out my apartment, without any issues.

I have done this on the basis of speaking with an immigration officer at Swampy who stated

that as long as the EOS is valid in my passport (not VOID-ed), I can enter & exit Thailand on it until it's expiry .

However, before I start a new job, I must apply for a fresh non-B outside the country to start the visa process again.

Recently, I have been offered a new job, and am trying to figure out what to do next.

The EOS is valid until 11th May, so I doubt if it will make any sense to cancel it now ( even if the old company agrees to do it).

Furthermore, I have understand that attempts to cancel it at this late stage, will invariably trigger an overstay fine.

I have been told that the best option is to wait until the existing EOS expires, and then apply for a fresh non-B outside the country.

Please advise.

Thanks all.

I think as you have the multiple re-entry permit your only option is to exit and re-enter with a new non 'B' after May 11th.
