'Baby Gammy' was not abandoned in Thailand, court rules

SYDNEY: -- A court in Australia has ruled that the biological parents of baby Gammy - the boy at the centre of an international surrogacy dispute - did not abandon him in Thailand and that they should be allowed to keep his twin sister Pipah.

The case follows a harrowing feud between the parents, who live in Bunbury, south of Perth, and the surrogate mother, Pattaramon Chanbua, who claimed the Australian couple abandoned Gammy when they learnt that he had Down’s syndrome and took only his sister.

It subsequently emerged that David Farnell, 58, the father, had a been imprisoned in the 1990s for child sex offences – a revelation which prompted Ms Chanbua to apply for custody of Pipah.

The child & surrogate mother in Thailand are being supported by an Australian based charity.

In W.A. where the couple in the OP live it's actually illegal for an offshore surrogacy contract, although so far as I'm aware no Australian has ever been arrested and charged for the offense. As you probably know Thailand has now banned surrogacy for foreigners.

The whole scenario is bizarre as the Court in Oz has directed at no time can the 'father' be alone with the other child living in Oz, every three months the child must be informed why she cannot be alone with him and a person has been allocated by the extended family to live in the house to ensure the child is not alone with him.

You don't see something disturbing in an arrogant Australian judge deciding it's o k for a convicted child sex offender and his Chinese wife to buy the surrogate services of an impoverished Asian lady; then split the twin children up, leaving the Down Syndrom twin but taking his sister; ignoring WA laws that make surrogacy contracts illegal and then allowing the nanny state social services to dictate all aspects of how the child is brought up?

Really, how soon will the daughter understand that every 3 months she is being told that the father is not allowed to be alone with her? A case of rote learning I guess.

I do think the judiciary have lost touch with reality sometimes in all aspects of this case (and many others). They seem to judge by the letter of the law rather than the intent of the law. Which makes their judgements challengeable? The law makers need to put more effort into making laws that are workable and according to the wishes of society as a whole. But the law makers need a job after politics? Wow I am a realistic cynic.

I don't recall her asking for a house or asking for cash nor asking for fund to be set up in support, maybe I missed something along the way, if I did, could you please enlighten myself and others of this important piece of information.

That opinion you mention holding more weight than the rule of law in his eyes. A very dangerous ethos to have.

Taking the word of a poor Thai girl with nothing to lose and everything to gain over an Australian judge doing his job and giving a verdict based on the evidence presented to him.

Just to be sure I rechecked what I said and it would seem I agreed the judge gave a sound response based on the information he had and at no time was anyone else other than the judge and Farnell / wife mentioned.
