Can anyone tell me the requirements that have to be met to obtain a 12 month extension to a Non-Immigrant B visa? Is this only possible if you also posses a Work Permit, or can it be done if you are conducting business here? What supporting documentation would be required?

Immigration in Bangkok, is no longer issuing extension of stay based on business( extension to Non-immigrant B or any other non immigrant visa based on business) to foreign employees of first year companies as the police order 7.1 #7 of required documents this document requires "Copies of the latest annual audit' which is impossible for a new start up formed this year until at the earliest after Jan 1st ( year end being Dec 31st)

However let's say your employer company was registered Jan 1st 2007, you then are looking at Jan 1st+ 2008 before you could apply for the extension of stay based on business. (even more time as the accountant has to close the books and the auditor has to do the audit.)

The advice, if your employer does not meet the criteria, is to get the one year multi entry visa at a Embassy outside Thailand. Revalidate your work permit every 90 days, by crossing the border, then going to the Labor dept and revalidating the work permit.

Penang stopped issuing multi entry visas even if you have a work permit, around a month ago.

One of the closest places that will give a one year multi entry visa with a work permit and three months of PND #1 ( monthly withholding tax) are 'KL" Kuala Lumpur, Malaysia

Hanoi, Vietnam is still giving a multi entry we understand as well with a work permit.

Is this only possible if you also posses a Work Permit, or can it be done if you are conducting business here?

Thanks Sunbelt. From all of the posts I've read, I assumed that this was the case, but as always, it's never safe to assume too much.

There is obviously a big difference in bureaucracy and logistics between coming here on business as opposed to working here despite requiring the same visa.

Looks like I'll be stuck with 90 days border runs.

As I understand the new rules one requirement for a 1Y Extension is the company makes enough profit to cover the Alien worker's salaryand benefits. Now, how is this looked at in the case of a startup Co. with a foreign worker with 3 month Visas and extensions thereof? This company obviously carries the foreigner's salary as costs in their books. Will they be required to show an extra profit of the same amount in order to qualify after the initial Year?

In overall the total revenue ( not net profit, just gross income) must show an amount higher than the total salary and benefit paid to the foreign employees.

Example: In 2007, the gross income must be higher than all of the foreigners salary and benefits paid in 2006 and if they hire an additional new foreigner at 50K per month salary (It then would be 600,000 Baht in additional gross income required in 2006)

so even if you are actually "entitled" to work here having the correct wp / company etc etc then they will not issue you with a multiple entry?

is there an actual reason for that ??

They are allowed the discretion to say "It’s their rule."
