Convert A Visa Exemption's 30 days Extension into a "Marriage" visa? Is that really possible?

Hello,

 

I'm reading that we can apply to some kind of Non-O visa or extension of stay from Chaeng Wattana office only? Is that correct? So we don't really need to go to Savhannaket then?

 

If I'm on the 30 days extension of my Visa Exemption entry. Is that still possible?

 

Is the letter from the Embassy enough regarding the proof of incomes?

 

Are the others requirements the same than for an extension of stay based on marriage?

 

I tried to find information before posting but it's pretty confusing and not clear about that specific topic.

If you have at least 15 days left of the current permission to stay it's possible to go from a visa exempt entry/extension to a 1 year extension of stay based on being married.

 

Before you can apply for the 1 year extension you go through an admin process at CW Immigration Office that converts your current Visa Exempt entry to a Non Immigrant Visa entry. This will take two visits to CW.

  • On the first visit you pay 2,000 baht for them to process an application for a Non Immigrant Visa. You will need the 400k in a Thai bank account on the day you apply, OR an income certified by your Embassy of 40K pm.
  • On the second visit, usually two weeks later, they will stamp a Non Immigrant visa in your passport that will immediately be used so they can also stamp a new 90 day permit to stay.

Once you have the 90 day permit to stay, within then last 30 (maybe 45) days,  you can go back to CW and apply for the extension of stay (1,900 baht). This time you will need to show 400K baht in your Thai bank account for at least 60 days, OR an income certified by your Embassy of 40K pm.

  4. Either one 4x6 cm photograph or one 2 inch size photograph
  5. Application fee of Baht 2,000
  6. 5.1 In case of a Thai citizen, please show:  A copy national ID card, a copy of house registration papers and a copy of employee’s or government officer’s ID card;or
    5.2 In case of a foreigner with a permit to reside in Thailand or a person who has become a Thai naturalized citizen, please show:  residency certificate, alien registration certificate, work permit, a copy of passport and house registration and a copy of documents showing Thai naturalization.
  7. 6.1 In case of marriage registered in Thailand, please show:
    - - 6.1.1 Marriage certificate (Form Kor Ror.2)
    - - 6.1.2 Marriage certificate (Form Kor Ror.3)
    - - 6.1.3 A copy of letter certifying marital status before registration of marriage or a copy of letter certifying that the applicant is single (In absence of such letter, a copy thereof can be obtained from the District Office where the marriage was registered.)*or
    6.2 In case of marriage registered in foreign country, please show:
    Family status registration (Form Kor Ror.22) and marriage certificate registered in overseas country
    6.3 A letter from a government office, embassy or consulate, certifying that the applicant is a member of the referred family*
    *(Documents under 6.1.3, 6.2 and 6.3 must be translated into Thai or English and certified by local or overseas Embassy or Consulate of the foreigner and by the Legalization Division, Ministry of  Foreign Affairs of Thailand) (For more information, please call 0-2575-1056-9)
  8. If husband is foreigner, the following evidence of income must be submitted.
    7.1 A guarantee letter from the local or overseas Embassy or Consulate, proving the monthly pension of the Applicant not less than Baht 40,000* per month; or 
    7.2 A guarantee letter in Thai language from the commercial bank in Thailand (Attention: Immigration Commissioner) and a copy of all entries of the applicant’s passbook showing that the applicant has a saving or fixed deposit account of not less than Baht 400,000*
    (Documents under 7.1and 7.2 must be issued and updated to be the same date of the Application and all documents must be in the Applicant’s name.)
  9. If husband is of Thai nationality, a certificate of employment must be submitted (certified by the head of his department not more than one month).
  10. Approximately 4 photographs of wedding ceremony or family pictures
     
Remarks

1. In filing the application, both husband and wife must appear in persons every time.
2. The Applicant must sign to certify on every page of the Applicant’s documents.
3. To be convenient and for speedy service, the Applicant for visa or visa status alteration must arrange and submit a complete set of documents in proper order and must prepare the originals as proof

Does this mean that the income guarantee letter (7.1) that I received yesterday needs a different date on it when I go to apply for my extension in a few weeks?

The income letter will be valid for 6 months.

That's what I thought.  Do you know what this is referring to:

 

Documents under 7.1and 7.2 must be issued and updated to be the same date of the Application and all documents must be in the Applicant’s name.

Some offices will want the letter form the bank (7.2) dated the same day, but Embassy income affidavits (7.1) can be up to 6 months old. They need to update the information on their website.

A Bank letter for most Thai banks can be done down on the 1st (ground) floor at CW.

Just have your pasport (for I.D. purposes) and your bank passbook with you.

They will print a computer form for you in less than 15 minutes for a 200 Baht fee.

That Bank letter will be accepted upstairs in immigration, and will be dated that same day.

Just ask one of thee cute tellers and she will type the letter from the info in your pasbook, and give you a signed copy for you to use upstairs.

That is an error. It should only be for the bank paperwork.

IF:

1-) I get 30 days visa exemption

2-) I extend it by 30 days for 1900 bahts

3-) Can I then extend the previous extension by 2 months based on being married to a Thai person? What are the requirements for this 2 months extension?

I'll be officially married between 2-) and 3-)

So if that is possible it would allow me 2 more months to convert the stay to a non-o stay in Bangkok, which require at least 2 weeks because of the 2 appointments...

Some offices might allow you to get a 60 day extension after getting the 30 day extension but many will not allow it.

Unless living in or near Bangkok applying for a non immigration visa in Bangkok may not be practical since it requires two trips 15 days apart to get visa/entry stamps.

It seems you best option may be to make a trip out to get a single entry non-o visa at a nearby embassy or consulate after you get married.

In your first sentence, do you mean that "many will NOT allow it"?

I'm near Bangkok.

There is no reason why you can't extend for 30 days for tourism followed by 60 days to visit your wife. You wife would need to go with you for a 60 day extension.

 

60 Day Extension of Stay

  • Original marriage certificate plus signed copy.
  • Signed copies of wife's ID and Tabien Baan.
  • Signed copies of your passport pages: ID page, visa, entry stamp, departure card.
  • 1 x photo 6 x 4.
  • Maybe they will want form TM30. This is the form used by the Owner/House-master to report that you are staying with them.
  • 1,900 baht.

I only meant to say that a bank account balance letter can be done downstairs on the ground floor in CW, no need to go somewhere else to get that form letter done.

Most of the usual Thai banks have offices down there on the first floor.

Just bring your bank passbook and your passport (for I.D. purposes).

No need to run around Bangkok trying  to get your bank letter signed the same day, it can all be done right there in CW in 15 minutes.

And it will be accepted upstairs in immigration.

Hello together.

 

My question goes almost along the same way.

I am currently living and working here in BKK. I have a Non B visa with an extension to one year based on employment, but I also am legally married to a Thai citizen.

 

Now I am thinking about to resign before my contract and WP expire. As much as I understand is that after cancelling my WP and extension of stay, I have either 24 hours to leave the country or can make a further extension of 7 days at Cheangwattana.

 

Since my wife and I are planning to move back to Switzerland, I need more than 7 days, is it possible before my resignation  to convert my current extension based on employment to an extension based on marriage at the Immigration and use my income from the Thai company I currently working for?

 

Feedback and suggestions are highly appreciated.

You could apply for a 60 day extension to visit your wife. She will need to be with you when you apply for it.

If you applied for a one year extension based upon marriage they would not accept the previous income for your job since you will no longer be working.

60 days is absolutely sufficient for my situation, I just think one week is quiet a hustle to organizing things.

Besides my passport, my wife and her ID as well as our marriage certificate as proof and the application form, do I need some other documents?

Your marriage certificate plus a copy, copies your wife's house book registry and ID card. Proof of residence will also be asked for.

You wouldn't be able to change the reason for your extension from work to marriage before the current permission to stay expired unless you resigned first and gave immigration proof that your job/WP was ending. In which case you couldn't use the income.

Not disagreeing but Surin Immigration will convert you over to a 90 day single entry O visa based on marriage or retirement if you present all the required finical and legal proof and you have atleast 15 days remaing on your visa exempt or tourist visa. Surin Immigration started doing this about 6 months back.

I have seen no reports of anybody actually doing it.

Knowing a bit about that office from reports I have read it might still be easier to go to Vientiane or Savannakhet to get the visa.

Again not disagreeing and you have a point, I have reported this on this forum. Most all reports and they get confirmed come from local forums not TV.

I have never heard of them asking for that. It wold likely be a notarized statement by the person applying for the extension.

For a visa application based upon marriage it would not apply. I think it is intended for dependent children to apply for the visa.

A mate has been to the CW immigration twice and been told he must apply in Rayong where he lives.
